During a few drinks with my mates and a quick game of truth/dare, a dare was suggested for a girlfriend of mine to drive to the garage and back whilst being topless! (she was not drinking that night)

Does anyone know the legal situation of this?

Would it make a difference if it were night-time and not daytime?

Is it an arrestable offence?


Please help me out, as i feel there are going to be more games of truth/dare! LOL

The constitution of the United States guarantees that "all men are created equal". In modern society, this means that "all people are created equal". So, since it is legal for men to appear in public without a top, then so are women. Most people don't know it, but that is a fact. There have been several cases of women being arrested for "indecent exposure" and their cases are almost always dropped when the constitution was cited. It holds up in court that you, as a women, have the right to go topless. But, do so at your own risk. Because, although I'm sure that a good lawyer could get the case dismissed if you were arrested, you probably will be arrested. But, if you want to push the boundaries and expand the rights of women everywhere, then I say, go for it. Just be warned that not everyone has an open mind and all it takes is one person's complain to get you thrown in the clinker.

All depends where you live,it sounds like you are in UK and the driving laws don't apply.Indecent exposure laws now say that the standards change to what is prevalent at the time so if people strip of there tops on the beach that is acceptable but how many topless female drivers have you seen?.It is not an arrestable offence which is a very serious offence.I think you mean can you be arrested?.yes if the circumstances warrant it.

In the USA you could be arrested for "indecent exposure". And in some states, they might put you in jail and throw away the key!

Not really....but some states are much more conservative than others, and in most states it's still considered an exhibition.
I wouldn't risk it....but that is up to you. And the time of day wouldn't matter. Of course, you would have to get caught...and arrested. And then it would be on your record.

Sorry...didn't see you are in South Wales....don't have any idea there. Know it sounds like an "old fogie"...but use your brain you were born with and don't let your peers tell you what you should and shouldn't do. Grow up and use some wisdom in your life. You don't have to do what they say!

If you were arrested and charged I reckon your defence would be a combination of sexual equality and the fact that any newsagent has certain tabloids, which anyone of any age can pick up, and which contain more t*ts than Springwatch.

I think that women driving topless tends not to happen because women seem to have the same hang-ups about their boobs that a large number of blokes do about penis size, but the issue for women seems to be more complex. I have never yet known a woman who was happy with her boobs. My previous gf was a 32A and wanted more; my present partner is 40DD and wishes she were smaller. I know of a woman who had implants and then couldn't wait to get rid of them.

Whatever you boob size/shape, I reckon you'd cause an accident or two by driving topless, so it's probably best to keep 'em UNpeeled when you're driving.

It depends on the local laws. In some areas, such as NY where I live, it's legal for a girl to be topless in public, so driving topless, whether day or night, isn't a problem. I've done it a few times without any problems, especially coming back from the beach. You get nasty looks from old ladies and lots of attention from guys, but that's about it.

On the other hand, if it's illegal for a girl to be topless in public it's probably illegal for her to be driiving topless, since her boobs would undoubtedly be visible to onlookers.

Best thing to do is check with the local authorities.

It isn't worthwhile to get fun this way.If members of the public phoned the police and a police car is despatched to check you out, you and your friends may get into trouble. I'm sure you will quickly get dressed and deny your mischief. Having taken all the time and trouble to speed to your location the officers are likely to check the whole car to see whether you all are committing other offences. The driver may take the breathalyser test and be charged for drink-driving.

It is natural, you see, that most people like to drink to get a little high before they do daring things. So you have been well-advised, ok?
Playing mild games of truth/dare indoors will be better.Have fun and good luck, but in a safe and calculated way.
One daring action usually leads to another more daring and one eventually ends up in court and jail.

Jail isn't a nice place to be - just consider the regrets of some celebrity who got it!

I am intersted to see the answer because I dont know either, they talk about equality but it would be wrong if a woman can be arrested for indecent exposure if a man can walk about topless, how many men out there would consider a topless female indecent? I love truth/dare by the way. good question. star for you

Strictly speaking this is Indecent Exposure and if the police decided to press charges they could.

Personally I suspect she would get a warning (verbal not formal), a lecture on being rather silly whilst driving a car and a warning aboutr getting stuck in traffic and assaulted by (a) drunk male(s).

Sorry have to nipple this idea in the bud.
Sadly it is illegal (indecent exposure) though the truth is more likely the increase in the number of accidents experienced by male drivers. We can only concentrate on one thing at a time and this would divide our limited spans of attention between two points of equal desire.
