I was jsut told some very disturbing news and plan on going to the dept. of family and childern first thing in the morning, but was wondering will I be charged with neglect or anything? My 5 y/o stayed the night with his grandma and his 13 y/o aunt made him touch her in her private area. I am going thru with taken actions required, but does anyone know if I am protected from legal action since I am the one reporting?

I have talked with my mother-in-law and she talked with the 13 y/o and told me she believes me and my son because she knows that her daughter is lying. She is as distraught as I am about this. But only tells me she is going to send the kid away, but I still must take action.

IN REGARDS TO THE ADDITIONAL ITEMS YOU'VE ADDED, I THINK RIGHT NOW YOU SHOULD CALL THE POLICE AND HAVE THEM INVESTIGATE THIS. IT'S 9:57pm HERE AND I DON'T CARE WHAT TIME IT IS WHERE YOU ARE AT, CALL THEM AND GET THIS INVESTIGATION UNDER WAY. LET HER SPEND THE NIGHT IN JAIL OR IN JUVIE AND HOPEFULLY THIS WILL MAKE HER UNDERSTAND WHAT SHE DID. CALL NOW AND GET THE BALL ROLLING.

I think the girl could use some counseling because she sounds like an emotionally disturbed child. How can any loving human being send a precious little girl away as though you were dumping a puppy out by a dumpster? The children were probably just playing "You show me yours and I'll show you mine."
Take the night and think long and hard about what you are about to do and see if your head will be clear tomorrow. You do need to talk to your child and explain to him that he did the right thing by telling you but don't ever touch anyone below the waist. Talk to the girl on her mental level and help her understand that what she did was wrong and, if she does it again, she'll be in serious trouble. It sounds like she's already had to endure enough heartbreak for a lifetime.

I know you are not asking for anyones opinion, only the facts. But at 13 do you really think she understands the seriousness of what she did? If this is reported she will probably carry it on her record for the rest of her life. I understand how devastating it would be to hear that your son was forced to do such things, and they both need professional help/counseling. Just think about what may happen to his aunt if you do press charges.
Legally speaking- unless you knew of previous abuse while leaving your son at his grandmothers house, you cannot be charged with neglect or child endangering.

Thirteen is a curious age for a child. Hormones are developing and they will start to experiment with their thoughts. Be careful because the thirteen year old may just need to learn a few things about his or her own body and thoughts. Also right from wrong. Unless you think this thirteen year old is a sexual deviat then do not report to social services or the police. Instead have a family discussion.

Everyone involved is seriously young... The 13 year old needs rehabilitation, not punishment. If you turn her in she'll probably get locked up with the state and loose all of what's left of childhood. Coming out of the system will not be easy. Sex offender status as a minor... I'd think the best advice would be to TRY to have a conversation first. Very tough situation but it's not a 22 year old who made a 5 year old touch her.

I can't see how you would be charged with neglect for leaving your child with his grandmother--unless there was previous abuse of your child that you knew about.
I hope both your 5 y/o and the 13 y/o get the help they need.

No you will not be charged with neglect.
When you report this crime to the Dept.of Family Service make sure you tell them exactly what your child told you.
Infact you should report this to your local police so when family service look into it they will see a police report on file.

No, I don't think so, if you don't report it that would be neglectful. I would be more concerned with being sued for slander if you can't prove that the allegations are true. : )
