I have a 5 year old daughter with a man other than my husband. I have never asked anything from her biological father who is in her life and spends time with her, but should I have him pay child support for her? If so should I ask for back support as I haven't been with him since she was 1 year old?

Have you completely paid for all the things she needs as well as her college education? If the answer is NO then you need to ask for child support because it is also his responsibilty to make sure she has what she needs. and is taken care of. I think they will automatically attach back child support from the date of seperation. Least that's how it is in my state. Do not cheat your child of the things she is entitled to. If it makes you feel better take each check and deposit into a savings account for her for college, asking for child support is not something us women should feel bad about!

Doesn't matter if you were with him for only a day, he's the biological father, and he should pay child support. This money goes to the child.

The fact that he is in her life is much more than a lot of kids get. If you think it would be more fair for him to offer monetary support, go for it. Well, actually I don't know if you can since you are married. You'll have to research. But if you can I wouldn't hound him for back child support. It's not like he's been hiding from you guys.

I would definitely ask for child support. Don't get your hopes up for back child support though, if it goes to court his attorney may argue that since there was no court order/ other arrangements for it he is not obligated to pay it for those past 4 years.

Please dont get upset at my opinion here. You have waited this long, if you are going to do this, dont wait any longer. But if he is ordered to pay back child support, you could set your daughter up an account for the money to be used for her college, or house, for her future. talk to your ex and see what he says. I mean, he must be a good enough dad to still be hanging around.
it was just a thought, i think its a fair one, but that is your choice. good luck

you should ask for some support .even if you dont think you need it and take care of all your own financial needs.you could put it in a savings account for her.she could use it for college or a car when she is older.as for the back support the child support office usually determines that themselves. he would start accumilating from the first day you sighn up for support.

You may not have the option. When I went to court, the court ordered my ex to pay the back support. I didn't really care but it has helped out a great deal.
I would discuss it with your current husband and if you decide to go for the back support you may want warn your ex. (Depending on your relationship)

Your child is entitled to child support. She will benefit from higher levels of living. This has nothing to do with you and everything to do with her.
