When we moved in, we were promised 24 hour security, and other things. On 2 occasions my brother got his headlights stolen, and the apartment office would not do anything about it. They also deny any claim to promising security and they gave my parents a cock and bull story about them having security already being in place when we moved in. They put up a security gate that doesn't work, people ram it, theres holes in the gates around the complex that people sneak in and out of as well. Would I have a good reason to sue or what types of legal action can we take?

Tex, everybody in my family has jobs. We are decent hard working people. I would go into detail into what type of person you are, but the Lord is my strength and my refuge, and through him I'm sure you will get what is coming to you. All I can say is you have no right to judge me or my family, or our living situation. I'm sure you haven't had any sort of struggle in your secure life living in a little bubble, but my family has. May the Lord help you to see that there are circumstances in life that can't be avoided. Peace to you.

Sounds like they broke their promise, but with nothing in writing it will be difficult to prove they are in the wrong. Do other tenants have similar stories so you can unite? That would give you a stronger base to build a case on.

This is talk to a lawyer quest as it is highly fact sensitive. Some things you might be able to sue for:
1. Breach of contract (the promise to you).
2. State consumer statutes
3. Negligence
4. Warranty of habitability

On the face of it, I would say probably not.

Is the promise of 24 hour security in writing? Like in your contract?

Regardless, providing security is not a guarantee against crime, it is simply a deterrent to crime. You can carry insurance to cover losses caused by crime. I doubt that they promised (again only really valid if in writing) to cover your losses from criminal activity.

not much, the best bet is to just call the police when things happen.

maybe the contract that the apartment complex has with the security place only offeres a few hours per night.
you will have to read the fine print on your rental agreement.

go to work so youll have $ to move out the projects....quit makin other people responsible for ur life



edit: the point is, work hard to better ur living conditions if what you currently have is unacceptable. im from dallas texas, a city with so much crime even JFK was knocked off here. ive seen more than my share of hard times, had prized possessions stolen from me, but suing my complex was not the answer. ur apartment's managers didnt steal from you, so why do you wanna recoup ur losses from them? you can get car alarms to prevent/discourage thefts. ppl here actually put camcorders in windows, pointed right at their rides so theyll have some idea who jacked them. you know how long it takes to get headlights off a car?? a car alarm wouldve alerted lots of people and the thieves wouldve run off. but yall choose to spend ur money on somethin else and then ya run to sue someone that wasnt responsible for ur loss. the only wisdom i saw in ur reply to me was "some things in life are unavoidable"...ur right, in this world you will be done wrong, and its unavoidable...so why is suing the apts right? they didnt steal from you.
by taking the apts to court, youre making another victim. that isnt very christian like now is it.

If some lady can sue McDonalds because she spilled coffee on herself, then you can sue your apartment complex.
