How do I need to go about marring an illegal immigrant without having him sent back to his country? We have been together for 2 years so it's not like it's for his green card but what is the actual process? Would it be easier for us both to go back to his country, get married, apply for Visa there then come back? I am so confused and can't plan a wedding until I find out all this information. I really, really need urgent HELP!!!

Marriage requirements are the same for all people. Immigration status has no bearing on your right to marry. As long as you are not currently married and are over 18 years old, you should be able to obtain a marriage license. If you are not in the United States and you want to come to marry an American, than you will need to apply for a fiancee visa.

You should consult an attorney for clarity. But by being illegal, he has broken the law and INS can deport him and even if you apply from outside of the country, the application can be rejected based on that fact. All depends on the country of origin. If he is from a country where there is a lot of concerns from Homeland Security, the application will likely be denied. It doesn't matter you are a US citizen, other concerns override that fact. Don't forget, he broke the law.

You can wait for the amnesty granted once a while but he has to be here. Still, if there is a concern about homeland security, he can still be rejected and deported.

He has to apply for change of status, and seeing as he is not in status he would have to go back to his own country and apply for the correct visa, however the fact that he overstayed his visa/holiday visa, will go against him. If he was here on a vaild visa it would not causes many problems. I suggest you go to a lawyer. Maybe he is just after getting legal status via you?
