Recently a friend and I went out to eat in this tiny town called Willis, Texas. As we were entering the resturaunt they were dragging a black man out, screaming," We don't want your kind here, and we have the right to refuse anyone". Is that aginst the law in Texas?

Were there any other black patrons in the restaurant at the time? If so it would be an indication that the man was individually a nuisance of sorts and had to be removed from the premises. Generally my experience in Texas has been that Texans want to do whatever they want disregarding whatever the laws of the land dictate. Sort of like GW Bush and how he just does whatever he wants even against Congressional influence. It's a cowboy mentality which is more prevalent in the smaller outskirt towns in which the law of bubba and Billy Bob rule the town. Similar attitudes existed in the deep south for many years and paved the way for subversive groups like the KKK to exist and literally get away with murder. If I were a black man Texas would be the last place on earth I would want to live.

Since you have no idea what happened before your arrival, ANYTHING said about the situation would be pure speculation (a big word for pure BS).

Based on the information you provided, what occurred is legal. They removed a person from their establishment. Saying "we don't want your kind here, and we have the right to refuse anyone" means NOTHING until you know the context of "your kind". Maybe "his kind" was a sexual predator. Maybe he touched a child. We just don't know because you chose to leave out any detail that would lead to a intelligent conclusion.

I suspect the purpose of your question was to fuel racist based hatred. I hope I am wrong.

That depends why they threw him out. Nothing in your story suggests race - it might have been that he stole something, refused to pay, had bad breath, was drunk, didn't have a tie on, was gay ...

A restaurant has broad grounds to refuse service; very few classes are exempt. However, if the reason WAS race, they would be acting illegally.

it could be more then meets the eye..maybe he was a drunk or a soliciter or one of those people famous for eating their whole meal then complaining about it trying to get a free check (seen a lot of those of all races) now if you heard them say they were refusing him because he was black then yes i believe that might be agiants the law but im not sure as they are a private business not a public business

Wow thats horrible! I havent heard that its the law in Texas. Why not call the information line. Im not sure if its 311 everywhere, but they should be able to tell you. Or google the Texas Laws online.

That's against the law anywhere in the US, and has been for between 40 and 130 years depending on how you view things.

In addition to assault and false imprisonment (kidnapping) charges, those people would also be subject to federal prosecution for violation of civil rights statutes.

If the sole reason they kicked him out was because he was black, then yes, it would be illegal. If there was another reason, then no.
