basically they both are uk residents and they wish to divorce they would prefer to go back to india to get divorced what would be the procedure they are both nri

if so would the decree absoulte be valid in the uk....

Any one married in India according to Indian matrimonial laws is supposed to get divorce according to the same Indian law governing the marriage & divorce then it will be legal divorce for all purpose & will be valid in any country including both India & Great Britain. If the couple wishes to travel back to India & want to seek such a divorce they will have to be present in person & file a joint petition for Divorce by mutual consent. They will have to wait for at least six months only after which they will be granted this decree of Divorce that will be absolute valid in UK. The only condition for such divorce is that they should be living separately for at least one year & such a petition for divorce can only be filled only one year after such a marriage. The time period which I have mentioned here about filling of such a divorce petition & grant of actual decree of divorce are statutory provisions.
