I worked over 40 hrs. a week, no overtime pay, see details????

I worked for 4 yrs at a marina/resort and many many weeks well over 40 hrs. I thought because I worked 9mos out of the year, laid off in the winter, I wasn't eligible for time and a half. Recently I found out that I was, and that has me a little ticked off....I live in a small town, everyone knows everyone. So I was a little hesitant to pursue filing a claim to get those monies...but the more I think about it, the more irked I get......If someone owed you 4 yrs of overtime, would you file a claim even though your friendship with these people will end...We aren't "friends" in the sense of the word, we're friendly, but don't socialize together...I'm not wanting them to get into trouble, but it is a lot of money, and the owner should have paid me. What do you think???

I don't work there anymore because instead of drawing unemployment for a couple of months, I went to work for someone that was needing help, and not scrounging during the winter was so good, that I decided to just keep the year round job...that has been 2yrs now. Didn't leave other job on bad terms at all.

Check with your local labor board. Sometimes certain trades (railroad, moving companies farms, etc) are NOT entitled to overtime. It's a called grandfathers clause . Marina's may fall under that same catagory. Hopefully, you have records of all your time sheets and paystubs,as you will need them to file the claim if indeed u are due the OT

The exact same thing happened to a friend of mine. Here in Canada, the labor law states that an employer can make any employee work overtime. Just as long as the employer pays the employee time and a half. I reccomend that you go to your local labor office and place a claim against your employer. I do believe they can only go back 1 year. Bring in all your pay stubs to back up your claim. Hope you receive what you so well deserve.

I would definitely check into it. If you actually are owed overtime money, then you should fight for it, in court if needed. Just because it's a small town doesn't mean that you can't fight for what rightfully belongs to you.

I'd check with a lawyer to see if there is statute of limitations on when they have to pay you, and what your legal options are for getting your money (if you still can).

Were you hourly or salaried? They probably thought you were salaried, and so they paid you the same amount every check.

Why didn't you complain when it first happened?

Do you know exactly how many hours that they owe you for? If not, what are you going to ask for?

Were you hourly or on salary? If you were hourly then you are probably eligible for evertime. If you were on salary, you are SOL.

go get your money! they totally ripped you off and its not fair to you. i'd fail a claim against them.
