im about to go to court for drink driving. the alcohol measure in my blood was so high, it was over 3 times the legal limit. I have been driving for 2 years and have never had any points on my license. I stayed with a friend one night for a few drinks, we ended up having an argument and told me to get off her property, i got in my car and tried to sleep it off in the passenger seat until the morning, but she made me get off her property. I was so drunk I FELT I had no choice and about 5 minutes down the road I crashed several times and my car was a write off
I have never had any criminal or motoring offenses before and am struggling to know what to do next. Idont tell me what i did was wrong i know that, and i know nothing excuses what i did. I am here for advice from people who have been through the same thing.. not for a lecture off peopel who think they are better cause they have never done anything wrong

first off, i'm glad that you and no one else was hurt during the incident....that's the most important thing.
what is going to happen when you get to court really is going to depend on what state you live in, the judge, and if you have a good lawyer or not. all states are cracking down on dui laws and consequences, but some, like VA are really putting a lot of emphasis on punishment for offenders. the new rule there is automatic 10 days in jail for first time offenders and loss of license. no matter where you live, you are going to probably get a hefty fine, have your license taken away for at least a year, and the court will probably order you to participate in some sort of class (asap, driver improvement, etc.). one piece of advice, when you go to court, i wouldn't even bother mentioning that you drove because your friend wanted you off of the property. most judges are not going to care about the story. if you show true remorse and take full responsibility for what you did, and show that you really know it was wrong, the judge might go a little easier on you-but again it's going to depend on your states laws, how he or she feels that day, etc.
sorry i know this probably isn't what you wanted to hear, but this is just what i know from experience with a few friends who have gone through the same ordeal.

What you need to do is get an attorney. Hopefully you can afford to obtain one on your own rather than court-appointed. I don't know what state your in, nor your age and the laws are constantly changing everywhere. I got a dui almost 5 years ago in the state of Ohio (twice the legal limit before the legal limit was .08)...I ended up with a 6 month license suspension, nearly $500 after the suspension ended to have my license restored, $500 in court costs and fines, close to $1000 in attorney fees (a friend of the family who was NOT cheap), and a $400 fee to attend a three day driver intervention program (court-ordered). The judge more than likely will not care about your excuse. Nor will s/he take too much into account your previously non-existent driving record. Would you expect a judge to be lenient on a person with no previous driving offenses, yet got behind the wheel drunk and kill someone? Back to the advice, get yourself an attorney and let them handle everything.

Well, although I've certainly done things that are "wrong", I've never done anything illegal or endangered the lives of others so I haven't been through the same thing.

Without preaching too much, I'll offer this advice---get an attorney who specializes in dealing with drunk drivers and (if your jurisdiction is tough on drunk drivers) get into an addiction program BEFORE you go to court so you can honestly show a willingness to attempt to rehabilitate yourself without the assistance of the judicial. Perhaps this showing of remorse will be enough and you will get off with a small penalty.

If you can't make rational decisions when drinking, you should refrain from drinking.

You should take good advice and understand that if you DON'T take an alcohol rehabilitation program on your own, it will more than likely be ordered for you. If you have already enrolled in one on your own BEFORE you go in front of the judge, the fact that you have "taken responsibility" for your actions will be weighed in your favor.

Apparently, though, I don't see any indication that you DO take responsibility for your actions. That isn't going to help you in front of a judge. They don't want to hear excuses. You have the wrong mental mindset at this point. Nobody is lecturing you. You asked for advice and you are getting some very good advice. If you are going to have to do an alcohol program ANYWAY (which is pretty much a given for a first time offender...the 2nd time, they get much harsher), you might as well use it to your advantage by taking the initiative.

It really depends on the state you live in. Most have mandatory sentences and penalties even for a first offense - so your past record really has nothing to do with it. About all you can do is explain to the judge what happened and hope he or she has some discretion in the case. They might go a little easy on you. Regardless, you will have some stiff fines, lose your license for at least 30 days, and may have to do community service. Most likely you will be required to attend some alcohol abuse sessions. Try to look on the bright side - if there is one to this. At least you didn't hit another vehicle and kill someone in the accident. Looks like you have been given a second chance to get things right.

Not much more than a pint is the limit Everyone is different but a pint is probably about the marker. It used to be closer to 2 pints but they reduced it. It's unfortunate that they can't find a way to test if you're drunk rather than the exact amount of alcohol in your system. So many people get banned for driving in the morning because they still have alcohol in there ststem even though there sober.

First offense, your attorney should be able to turn this fact pattern into a conditional discharge (probation) though it is likely that your license will be gone for a while. You've been driving for two years: did you start late in life? The foregoing was on the assumption that your sole problem was drunk driving, but if you're also underage, the profile is different.

Retain counsel. Get treatment for the alcohol problem. Good luck.

Well you're going to need to get a lawyer for this one. With a BAC at 3 times the legal limit and crashing several times you could be in for a pretty bad time. You'll probably lose your license for a good amount of time and possibly have to do community service.

You had a CHOICE... YOU drank. YOU didn't use the common sense to pick up a phone and call another friend, a taxi .. CRIPES even if you had called the cops and explained to them you were having an arguement and had been drinking THEY would have picked you up to take you home.

People who drink and drive disgust me. I was hit by a drunk driver while pregnant with my daughter. That JERK for lack of a better word left me laying on the side of the road screaming he hoped we died. He spent a year in jail and I wish that judge presided over more of these cases stopping people from thinking its perfectly acceptable to get behind the wheel of 2 tons of metal and send it careening at people who think they are SAFE driving themselves or their children home.

I think is better to tell the truth and tell them that u won't do that any more of it. Just be brave and thing positive and u might get Ur driver lens-enc soon.
