The day after my mother died, my aunt and I were in my mother's apartment (located in another state) and were startled by people entering the apartment. A lady from the rental office let in a neighbor to retrieve some luggage she had let my mother borrow. We had been at the apartment since early the previous day and there were no phone calls or knocks to the door prior to them entering. The neighbor that had herself let in to the apartment knew I would be coming to take care of things, but was unaware I was already at the apartment.

You should have the apartment complex prosecuted for assisting in a burglary.

Send the apartment management a CERTIFIED (RRR) demand letter telling them that any and all claims for the return of property in your mother's apartment are to be made IN WRITING to the estate.

Also, inform the management that under no circumstances are they or anyone else to enter the apartment without 24 hour notice (give them a phone number and address). Inform them that if your wishes are not met, you will have no choice but to file a police report for illegal entry and a civil suit against the management of the property for theft and illegal conversion and illegal entry upon the premsis.
