I sold some tickets to a guy, he paid me with a personal check, but the check was returned, with the legend "Unable to locate account". So, basically, this scum gave me a fake check. I have his home phone number, I know his name, but, what it is available for me to get my money back, or, make this dirt bag pay.
I learned my lesson of not accepting checks from nobody.. please help guys! Anything is appreciated

Threaten him, writing bad checks is a crime.
Tell him you need the money by xx time or you are reporting this to the police.
If he gets arrested, you may not receive your money, so hold it over his head for payment.
Otherwise you can sue him in small claims court but you'll need an address to have him served.
When you win in SSC, he'll have to pay the court fees plus interest.
You will need proof though.

The laws for collection are different for each state. I have had this problem in the past and discovered that I needed their correct DOB and driver's license number in order to take proper legal action. You didn't hear this from me but I believe your best bet is to do a little research and find his address by using his phone number and just show up to collect. Sometimes people are so surprised that you are confronting them, that they give you the money right there. I don't recommend this if they are in a bad part of town. (Also, I'm a pretty big guy.) I have on occasion arrived at a house to collect and no one was home. I took their personal property as payment. This is the eye for an eye approach and it is illegal and considered theft. If they don't have to money to pay you, then they certainly don't have the money to prosecute you. You can also turn it over to a collection agency. The agency would probably take 100% of the money recovered but it's worth it in my opinion to have them harassed by an agency. I don't take checks at my current business.

Not much you can do to collect from him particularly since I doubt you looked at this man's i.d. If he gave you a fake check chances are it was a fake name too. If you have his real name you can file a small claims case. Has the event happened? If not you may be able to have the police pick him up there or have him served. I think you've already learned this but NEVER take acheck from a stranger unless it is a travellers or cashiers check.

if it's worth it to you, you can always do small claims court. No lawyers required. You file the paperwork to sue him there, can pay a fairly low fee to the Sherriff to serve him, and the judge makes a decision on the spot, if the dirtbag fails to pay, you win summary judgement and can then go after him with the court backing you up (think how he'd feel if he got a court ordered paycheck deduction over a check like that).

If you can't get the money from the guy, take the bounced check to a Magistrate at your local court house. Explain what has happened and the Magistrate may issue a warrant for his arrest.

First call him maybe he grabbed the wrong check book and can replace the check and the NSF fee with cash. Then if that doesn't work file a police report it is illegal to write checks you knowing they aren't good.
