In many states, a paralegal CANNOT legally assist you, the consumer; they may ONLY be employed by attorneys. According to the American Bar Association, "A paralegal is a person qualified by education, training or work experience WHO IS EMPLOYED OR RETAINED BY A LAWYER, law office, corporation, governmental agency or other entity who performs specifically delegated substantive legal work for which a lawyer is responsible."

What you need to look for is a Legal Document Assistant (LDA) or Legal Document Preparer. These professionals can prepare legal paperwork for you to file with the court if you are representing yourself. Laws vary from state to state, so be sure to check before you hire someone.

As an example, California law requires document preparers to register as Legal Document Assistants and to post a bond for the protection of the consumer. Of course, there are always those who do not follow the law and who advertise as "paralegals"; these people prey on the ignorance of the consumer who needs their help and doesn't know any better. These people are illegal operators, and have NOT proven that they meet minimum education/experience, and have NOT posted a bond for your protection. And who wants to trust a "paralegal" who can't even follow the law?

In no event can a paralegal provide you with any legal advice, consult on strategy, or represent you in court; that is the unauthorized practice of law. Good luck to you.

My experience in the Chicago market is No, although I do not understand why. If a licensed attorney wants to be hired into a law firm and there are no 'attorney' positions open, the common practice here is to hire them in as a law clerk. The licensed attorney/law clerk is then given additional responsibilities such as making simple appearances in court. Actually that is a win/win situation, the attorney gets that basic training which is lacking in law school, and the law firm gets a law clerk who is more knowledgeable and can do more. I have heard that the reason an attorney is not hired in as a paralegal is due to the specialized training that paralegals get, at least they do in the Chicago area.

A paralegal can perform legal research, and can help fill out paperwork. But a paralegal cannot represent you, speak on your behalf, or give you legal advice. In other words, the paralegal can quote a law, but cannot tell you whether the law applies to you or what the law actually means.

Freelance paralegals are available in the yellow pages, and what they can do is help with research for a court proceeding. They can go as far as drawing up the actual documents, but thats it. They cant appear for you, they cant give you legal advice and they cant sign off on any official papers. Doing any of these things would be unlicensed practice of law.

Yes, you can hire a paralegal. They are kind of like nurses are to doctors, they can give you advice but they are not fully qualified. Many law firms have them for hire.

my ex wife is movin out of state n the paper state that she can only mov 50 mile from me,i need help n stopin her from movin on jan,if she moves then i will not see my children at all,i do not know where in new york she is movin too either,i you can plz help me in anyway you can to stop her from movin,thank you
