it was supposed to go through friday and it didnt and they said wait a day because of the holiday so we did and still no check well in the meantime i had to write checks for our insurance payment, registration, I had to get perscriptions, groceries, gas, and phone so I have 6 things that are out.
I called my bank and the check is now showing that it is a pending direct deposit but isnt going to clear to Monday morning- Im going to have a ton of returned check fees

Can his employer be responsible for thoes fees cause I know the place I wrote the check for my perscriptions said a bounced check will be charged 3x the amount of the check.

His employeer would not give him a paper check it had to be direct deposited Im pissed!!!!

His check should of been in 4 days ago!! Its kind of hard not to pay your bills when they are due when it is not your fault that the money is not in the bank. You got to do what you need to do especially when you got sick kids that you need GAS in your car for to get them to the hospital and you need money for their PERSCRIPTIONS!! It not like we went to do something that was not needed.

Talk to your husband's company about it not being posted on Friday.

This same thing just happened where I work and an email was sent out stating due to the snag, if anyone encountered financial reprocussions such as bounced check fees, to notify them.

They did say there would have to be proof of the financial problems due to the delay in payroll being deposited.

If your husband's company was at fault for the delay, they should do the proper thing and reimburse employees for any fees incurred due to their snag (if it was a problem on their end).

um, you should never write checks until you confirm that funds are deposited. just because you're on direct deposit that doesn't mean the money will come in at the same time.

you shouldn't have written those checks until you were 100% sure the paycheck was deposited. Your fault entirely if you suffer overdraft fees and bounced checks and their associated fees.

If the money is pending, that means the funds aren't available yet.

Also, you should examine your expenses situat8ion if you are solely dependent on your husband's paycheck and are living paycheck to paycheck unable to keep additional funds on the side to cover bills should a paycheck be late or something goes wrong and it doesn't get deposited on time for your bills.

You should always have a minimum of $5000 in safe keeping (like an untouched savings account) for emergency purposes (ie funeral trips, car repair, loss of job to cover bills, etc)


Company isn't liable for any overdraft fees that occur. His company has up to 30 days to pay him that missing funds.

be responsible for your mistakes. You should make sure the funds are there first! Again, you need to examine your expenses and find a reason why you are living paycheck to paycheck, and cut costs where you are spending money frivolously. That way you can build up your reserve finances IN CASE THINGS like this happen.

When that happened to me the bank voided the overdraft fees.

I went in and they said they could see it was there snf had no reason why the funds had not moved to my account (since it was drawn from a company account in their own bank and it was processed by ADP Payroll for the employer). They couldn't blame another bank and they didn't want to lose a fight with ADP so they just canceled the fees.

No, they aren't responsible. Anything can hold up a direct deposit.

It is your responsibility to have the money in the bank to cover the checks you write.

You should have confirmed deposit before you sent the checks out......

I would have him contact his employer and explain the situation. Hopefully this will not occur again. This is the danger of living paycheck to paycheck. While they may be responsible for late fees, I am not sure it is worth your time to pursue them in court.

The company could be liable for the late fees and overdrafts if it's their fault. have him talk with HR and then pursue other avenues, like small claims court.
