Yes they will be charged just as a person who is driving drunk and hits little Timmy who just so happens to be playing on the interstate that night. The charges will be negligent homicide. Not as serious as murder, but they shouldn't expect to see open fields for at least 10 or more years.

That really depends on the state. I would have to think that in most states you would end up spending some time in jail.

It's not a matter of can they go to jail, it's a matter of how long will they go to prison for.
