You have three options.

Option one -- the injured party decides, and exacts revenge in the name of justice.

Option two -- whenever there's a conflict, the two people/sides involved get put into a room to sort it out. This may or may not include the use of violence (honor duels) or it may be limited to just reaching a settlement agreement (mediation).

Option three -- an impartial third-party (or group, like a jury) decides guilt. Under this option, you can either have people argue their own sides, or have a professional advocate (lawyer) speaking on their behalf.


All of them have been tried, and all of them work in some situations better than others. The last (courts and juries) is what we've come up with when the other two don't work.

While many details can be improved, it's still the most consistent and likely to result in actual fairness and justice.
