It's legal if all were asked for a photo.

And, sorry, Mr. Bounty Hunter, while they can't discriminate on the basis of a protected class (religion, race, disability) they can only hire "pretty" people if they want. That's why you don't find many 450lb toothless strippers in America's clubs.

A receptionist is the public face of the firm. They may indeed be looking for a good looking one. And it's their right to do so.

I'm sure that since you didn't go in for the application and since you will be in a doctor's office, you will be meeting people. The probably want someone with a good appearance. And alot of employers will take a pic to put a face to the application. I had one taken when I worked for a women's clothing store.

it's illegal to ask your age, your religion, and if your pregnant, I don't think the picture is illegal, I just think they want to make sure if your ugly or not, you will be sitting at the front desk after all, it's not right but that's the way the world is. They're going to see your face anyway, a lot of people don't get hired because of their appearace whether it's their fault or not.

Yes, they can legally ask. You can always refuse.

The tricky bit is WHY they want the picture, since an argument could be made that it would be used for unfair and illegal racial or gender-based discrimination, rather than for any legitimate purpose.

I am in a position where I go over applications, set up interviews and can hire people.

NO, you CANNOT ask for a picture, unless they need it for, say, acting or modeling, etc.

If you are in a job where your looks shouldn't matter (as in the one you mentioned), they can't ask b/c of discrimination reasons. They can't base their decision on your looks. They have to base it on your qualifications.

However, if, chosen, you may have to follow certain appearance guidelines, such as amount of jewelry worn, no visible tattoos or piercings, no extreme hairstyles.....you have to have a certain level of hygene (no greasy, dirty hair, not too much make up, etc.). But they still can't ask for a pic....

It sounds like they are hiring based upon looks. They want to hire a good lookin babe. This sounds too creepy to me. I wouldn't send in a pic. Don't do it.

the CORRECT answer was the very first one you received.

Now, how would I know that? How about 35 years of legal practice as an attorney.

If they want the photo to screen based on race it is illegal.

If they want it because the only hire really hot babes, it might not be illegal (I am not sure) -- but it is creepy.
