I'm 36 weeks preg. and the father is either my 2 year old son's father, or an ex boyfriend.. and my son has his father's last name of course, but I was wondering if I can put his last name on the birth certificate, instead of putting mine.. and just leave the father blank untill we get the paternity test results?

I would like the boys to have the same last name, even if he turns out not to be my son's dads.. and he doesn't mind if I use his last name, I just wanted to know if I could do it legally.. and we are doing the paternity test right after the baby is born..

In most states, you can put pretty much any name you want for the child on the birth certificate (within reason). And you can always leave the name of the father blank by claiming it is unknown.

However, putting someone else's last name on the birth certificate does not create any legal relationship or obligation between that other person and the child. It just means your child will not have the same last name as you do, which can cause all kinds of confusion later on.

Oh boy...I think there is a time limit on naming and getting a social security card...Ask your ob about doing paternity or call and talk to nurse at pediatrician's office about this matter. The sooner you get this tended to the better off everyone wil be...My thought is why name the father of the two year old if it is your ex boyfriend that may be the father...the child support...I am sure being adults that everyone will cooperate...You are turning this into a three ring circus and legalities are at stake...lotsamoney for the legal if you dont determine paternity right away.

Legally, I don't know, but morally, you should probably put your own last name until the paternity is determined.

Why not put your last name? Female powe ris good! If your aren't married or exclusively together with one partner being the father of your children you still love your kids but they're yours. I'm sure you could put his last name legally but you could still put yours.

I believe you can give your child any name you want, first or last.
