You don't need his permission or signature even. If he doesn't sign the papers, he's simply waiving his rights to fault and anything he might have acquired during the marriage and it's been a long time so no issue.

Go ahead and file your divorce papers, even if your ex refuses to sign them, the judge will eventually sign the decree and your divorce will be final. This takes a little longer than normal, but it will be well worth the wait...besides, you've waited five years already so a few extra months isn't going to kill you.

This happened to me. My ex refused to divorce me, but, all you have to do is go to a divorce lawyer. It cost me a little over a thousand dollars. You can do it without a signature from him. In fact, I did it in another state without him seeing any paperwork besides the divorce decree my lawyer sent him when all was said and done!!

Check into the no fault rules in your state. He doesn't have to sign anything. Here the law is after one year you can file no fault, try to locate them, otherwise, a divorce where no one is at fault---a lot easier than a messy one.

File for divorce. Even if he doesn't want to give it to you...he can't refuse. He doesn't have to sign. Get an attorney.

Someone can not make you stay married. If they are uncooperative you can push it through the court to th point they are forced to divorce you. You need to speek to an attorny though,
