You need to obey all employment laws and pay all taxes and insurance. You don't really need to sign an agreement with the employee. If you are afraid they will take your customers and leave you can have a coventant not to compete, if they don't honor that you can do something they agreed to like taking back the match on the 401K.

Hello!
I am not sure what circumstances are, but I was hired by a small business for cleaning once. I was required to get a business licence and become a "sub-contractor". You might check into the legalities of that.
