There is this enormous pothole on a local road. And I know it is there. I drive the road daily but today I was referee-ing a fight between my 2 youngest and the teenager had the music up.....I swear my car actually FELL into this pothole!

Sure, but almost nobody ever wins (except the lawyers) against any city for these, most especially in the cases where the driver who hit the hole knew it was there. If you hadn't the hole while driving distracted, you could have hit another car, or a person.

You should be able to get some type of compensation. Potholes aren't exactly the safest things around. There's loads in the city I live in and I swear, people get into accident swerving around them. I say go for it. The worst that can happen is that they say no. Might as well try.

You should have stopped the car and called 911 immediately. The police could have come out to document the pothole and the damage it caused. I am not sure you have any proof to file a claim at this point.

You would have to talk to the mayor.
I am sure that it is quit possible to sue
whomever created that pothole.
However if you weren't paying attention you might
get a ticket.
Also this conflict might have to be
moved into a court room and you must be sure if you are
willing to do all that becuase of car damage.

Anything can happen in America. I heard that there was a guy who sue Mcdonald's for making him fat, and they paid him millions of dollars. Hope that when you get rich, don't forget about me.!

I don't think you can sue the municipality. Unless there was a way to prove their negligence on this matter. You may rather petition them to fix it.

I'm not sure because in a way you would only be sueing yourself considering they make their money on taxes...but I would think you could if you could prove it in court
