it really depends on the divorce settlement. Talk you your guidence counselor or better yet your dad...... He'll understand why you're asking.

Kitty, sorry for your problems but there are 2 separate items involved here:
1. Dad gets custody of you through the courts as the best parent for you at this time in your life. Means the courts feel he will give you the best care, education, upbringing etc.
2. House payments are separate from everything. If he cannot afford the payment he will need to contact his mortgage company and hopefully make arrangements for a lesser pay each month. Or perhaps he and you would have to move to an apartment or less expensive living quarters.
The problem, and you don't want to hear this, is if he is in financial difficulties (other than the divorce settlement issues) the court may not award him custody as not being able to control spending etc. Please realize this is just my opinion, I have no legal training.
Best of luck to you and God Bless!

Geez, what a mess.

Your dad having full custody of you won't change the situation with the house - if he doesn't make the payments, they can still foreclose.

Good luck to you and to your dad - I hope things work out OK.

Custody have nothing to do with a mortgage pmt. But if he will lose the house, he will have problem to get full custody.

oh you poor thing going through that horrible predicament. if your mom is paying your dad Childcare $ than he may be able to keep his house on that money plus his income.
