I am a european and i married a Bengali man recently. Before he was so nice and loving. After the marriage registration i had to go back to europe for a few months. This is when the nightmare begun. He started suspecting me in cheating with other men, i am sick and tired of answering the same questions. he`s like deaf. He even became very abusive. Calls me a *****. Even before i left India a couple of months ago- he even hurt me phisycally.
More than anything in my life i want to divorce him now. I can`t believe i was so stupid to marry him. Can anyone tell me whether it`s possible to file for the divorce and divorce without travelling to India? how much time and money would it take? I would appreciate it a great deal. I can`t live thinking i will not be able to divorce him ever. please, help me.

Before I give any details about the way for dissolution of this marriage I want to know these facts about your marriage. 1) What were your religion & his religion at the time of marriage? 2) What form of marriage you under go with him in India? 3) If at the time of marriage you were Christian by religion & he was Hindu & you married according to Hindu form of marriage, did you convert to Hindu religion before this marriage, if yes where & was there any certificate with this regard issued to you ? 4) You say this marriage was registered, under which matrimonial Act of India it was registered? Was it under section 8 of the Hindu Marriage Act, 1955 or under the Special Marriage Act, 1954? 5) How long back this marriage took place? Date, month & year? 6) Where in Europe you live? Which country? All these questions & their answers will help me ascertain whether your marriage itself with this man is legal or not, then only I can suggest what line of action you can take in furtherance of dissolution of this marriage , how & from where. In case it comes out that the very fact your marriage with this man as you call it is not at all legal & valid in law, no use wasting you time for getting such marriage dissolved for getting which you should have a legal & valid marriage. Mind you simply getting any marriage registered itself is only a proof of marriage but if any condition of the marriage required to make it valid is infringed can make such marriage void, that I have to see in your case. As it has come to my knowledge many non Indians married to Indians never knew the actual conditions for valid marriage & either never undergo the required ceremonies or failed to fulfilled the required conditions of a valid marriage, they were just caring a marriage certificate but from the legal point of view they never got actually married to the Indian person. This is the reason I always tell all those ladies specially who are being eluded by some Indian man should first check the necessary conditions of marriage in India then only proceed with this. I have just replied an American Lady who purpose to visit India in next 10 days for getting married to an Indian man, how she should proceed with such marriage here.

Since u've decided on gettin a divorce then suggestions 4 counsellin or reconcialition are out the window.

This is wat u shud do 2 make his sorry *** pay-

1) Call him at the first given opportunity
2) Let him threaten u as well as accuse u
3) Record the conversation
4) Keep it 4 future record
5) Send an email, with all the details of mental n physical abuse perpertated on u, 2 ur Country's Consulate in Kolkata. Make it clear u want a divorce.
6) Wait 4 their response.
7) More than likely 2 save himself as well as his family from any further trouble he wud divorce u without much pissin bout,
8) If he's still makin it hard for u. Get ur counslate 2 give u contact details of the nearest Women Cell 2 his residence. This is where u register ne such complaints. U might have 2 travel 2 India and get a consulate official 2 accompany u 2 the cell offices later on 2.
All this shud oughta do the trick if it doesn't then there are some more drastic measures which can be brought into practice.
By the way I hope all this hasn't put u off of India n Indians.

Unilateral divorce takes considerable time, especially if the other spouse contests the case. Mutual divorce is relatively quicker. Costs depend on the quality of the attorney pleading your case and the time for which the case is prolonged. Visit India at least one more time to consult a good divorce lawyer and tell him/her all your problems.

You can stay away from India for six months and then you can file for a divorce in the country where you have stayed for a day more than six months. Make sure you file for divorce first. I hope you get away from the jerk.

Hire a laweyer who is specialist in divorce cases. Explain your case to him and take his advise. I think it will take about 3000-4000 $. Normally lawyers charge the fee per hour.

If you really want to divorce, the laws of your country apply.You don't need to go back to India. Just make sutre that divorce is really what you want.Some people see a counsellor or marriage guidance.

yes sure this can be done. it may cost according to the lawyers greed, anything between 10-15 thousand.... may be little more. appoint some proxy but yu will hv to be on the date for appearance and reply the arguments yurself. this much more u will hv to suffer to get rid of such man.

Get a lawyer. They can handle the divorce for you.

Wow! I'd say hire a lawyer and start finding out immediately what you can do to end this nightmare!
