A window airconditioner unit had caught fire and in one of the bedrooms damaging the walls, floor, electric, e.c.t. But the frame and structure of the house hasn't been burned. We've been making repairs and then the city leaves a sign on it "CONDEMNED" and we needed to get 3 kinds of estimates before 10days or we would loose our property. Well, we got the estimates and filed before the 10day deadline and were told they would contact us for the hearing and they haven't. It's been almost 2 months and the house still stand (by law we can't work on it). What do we do? Can we file a complaint against the city for damages caused by not allowing us to work on it. (pain and suffering maybe) Are there laws on how long they can keep us on hold? What do we do?

You get a local attorney, immediately. This is NOT uncommon, and there may be nothing you can do. However, a local attorney will provide you with the best assessment of your situation. Under these circumstances it would be extremely unwise to proceed without an attorney. One problem you will have is getting anything for your condemned property if your appeal fails. Cities under pay. Period. Without an attorney, you will be stuck with what you get.

If you were insured contact your agent and see if they can assist. If the city issues a demolish order the insurance company would have to pay out on a total loss.

You should contact the city regularly and see a lawyer about a damages claim.

Go to www.okc.gov. There are forms you can download to file an appeal. The site also contains all the phone numbers and info you need to contact the proper officials. Without more specifics it is hard to answer regarding your legal rights.
