I forget the name of the supreme court case that explains the distinction, but basically porn is protected speech under the 1st amendement, prostitution is not.
When I read the case my reaction is thats nuts. Most of my classmates had the same reaction.
There is a guy trying to do basically what Tex is suggesting (see above) in Michigan. I have not followed it in the past two years but 2 years ago it was unclear if the court were going to call that permissiable porn or prostitution in fact.

Because it is loosely called acting.I have watched a little porn,and don't know why people buy it,My imagination is better than they come up with.But anyway,i think it just might be a very thin line between the two.Besides the government can't tax a bl*w j*b you get in a hotel room,but they do get to tax the actors,and then tax the sale of the dvd.It is about money,like anything else.

Both actors get paid, male and female (or otherwise, depending on the film) which makes it not prostitution. Porn is also a multi-billion dollar industry in america, which gives it a lot of power to lobby, or bend the rules as they see fit.

The same reason that it is illegal to spank a child that is misbehaving in many places,and so many people threw a fit when the police officer used a taser on that child that was kicking and fighting him,yet it is ok to destroy your unborn child if you want to.It is illegal to mug someone,yet the government steals from the citizens regularly.It is being discussed that the people be required to carry health insurance yet the government will be exsempt from our lowly type of insurance.The judgement of America is so corrupt and misdirected that it makes normal people sick.It will get worse before it get`s better as well

Have you actually read the law? If you do that, you will probably find the answer to your question in the wording of the law.
They are actually being paid to act. And a pimp is someone who hires a girl out to have sex and takes her money.

Because they are not prostitutes, money doesn't exchange hand between actors and actresses for the act of sex, but between management and the actors and actresses for performing the act of sex, that's the difference.

ive often wondered the ssame thing....im also seeking investors to help me build a movie studio, i plan to hire talented women actresses and let men write their own scripts, direct their own movies, and take home a copy for them to remember the day when they starred in an unreleased porn movie....thats not pimpin, its more like reality tv right?
