my friend is a female 34yrs. old, married, two children in the state of nevada.her and her husband have been fighting for some time now. lots of verbal and emotional abuse both ways. two weeks ago he talked her into going to visit her girlfriend out of town saying it would give them both a break. so she did. when she returned he had takin her name off the lease of their condo, changed the locks, sent the kids to there grandma s (her mom) and now she only has the bags she left with. her mom is saying that if she doesnt have a place to live she is seeking custody of the kids. he is claiming that she left (walked out) on them all. I feel bad for her. she is scared of this *** and doesnt want to cause him any greef in fear he will do even worse things to her. HELP she needs to do something.What? her life has been takin , whats the right way to go about it?

She needs to get a good lawyer YESTERDAY and document every conversation and action made.

Unfortunately,this is a little more than the average person could fight alone in court so it would be very advisable to get an attorney here. First, get a protective restraining order against him to stop any abusive action against her. Give her mom temporary custody of the children to prevent any permanent custody action by anyone else ti she gets back on her feet and prevents the kids from going to a foster home too. The attorney will advise what to do next,but remember alot of this will be her word against his into what actually occured unless she can prove he forced her out. If she cannot afford it she can always contact your local legal aid assoc.for possible free legal help. Good luck

Get a lawyer, document all conversations, if he leaves a message on her phone she need to keep it. She is married to him thus 1 half of everything accrued during their marriage will be hers. He is using the kids as a way to get to her and make her do what he wants. If this can be shown then the judge will nail his a** to a wall. He has to prove she got up and left them. Just taking a few days of clothing and not having her mail forwarded to a new address may prove she did not just up a leave them. I say get a lawyer and one that is a real SOB. He is going to fight the whole way and see need someone who knows that states laws regarding custody and I may even say parental kidnapping. It will cost her, they don't work cheap but if she wants to win she had better do it.

as far as the condo, he has probably told the landlord that she left...landlord can change the locks, and take her name off of the lease.
as for the kids, she needs to get an attorney. no one else can legally help her. she needs to take this to court, and get custody. however, if the husband can convince everyone else that she left, she is in deep trouble!! he can get immediate exparte...emergency custody due to abandonment. even though it was a planned trip, he may be able to convince people otherwise.

sad that this has happened, and i suppose her mom is not gonna be much help?!? she is probably on his side, too huh?

Get professional help. This is illegal - she needs a lawyer. The man is a bully.
My friend changed the locks after her husband walked out on her and she got into trouble. The fact that she only do it because he had raped her, didn't count. There was no evidence.

He can't take her name off ANYTHING without her signing off. AND...if she goes to the police and tells them he changed the locks on her while she was out of town, he will have to give her a key. He just wasted some money!

Lawyer can help.

If SHE signed papers on the condo then no he can NOT legally have her taken off without HER signing off on it. She needs to consult a lawyer ASAP

Ask your "FRIEND" to tell you the truth. This story doesn't ring true.
and yes I can make that assumption. I've seen this same story over 35 years of legal practice and it ALWAYS has more fact that you are not hearing.

police, this is totally out of her hands and this guy deserves to be put in jail.



i think its most unfair to the kids tho
