Does he get raped by male inmates? I was thinking about it & it's kind of funny if this is true.

This only happens in the movies, or on Saturday Night Live.
Usually a person who commits a hate crime will not be sent to a maximum security prison but to a minimum security facility. And this is true if this is that person's first offense.
More than likely this person will spend no more than a month or two or three in the County Can much like Paris Hilton did. A first timer hate crime is not taken to the same level as a robbery, physical assault, rape or murder.

*Every* crime is a "hate crime"; so laugh your *** off! The only class of people I've actually heard about who get very rough treatment from other inmates are pedophiles. That and law enforcement personnel who commit crimes warranting prison and are then incarcerated with some of the men they had previously arrested.
But, I'd bet that a big, burly guy who is imprisoned for a crime against a homosexual (who would more properly be called a "sad" than be called a "gay"), wouldn't get raped by other "sads"!

Depends on the prison. However, in all but 1 state he/she is NOT convicted of a hate crime. Only of plain vanilla crime.
