I have a 4-yr old son in a 10-yr old marriage and recently found out that my wife has been married to another man during our marriage? We have been separated for 1 year now and no chance for reconciliation. What would you do? How is this matter viewed in the legal system? What are my legal options? (of course, I will hire an attorney but want to be prepared when I talk to him/her).

This is so bizarre and can't believe this is happening to me. Thanks.

then they are not your spouse at all...or the other man your so called "spouse" is married is actually not married to...What I'm saying is that one of the marriages is void...

It's simple you tell the attorney that your wife has committed Bigamy, show him the proof & also notify the cops about it w/ the proof Bigamy is a felony!! You will not have to go thru a divorce, you can simply get an annulment b/c your wife decieved you into marrying her! That way it'll be as if the marriage never existed in the eyes of the law.

This is bigamy. It is illegal in most states and because of this, if you were the second husband, then your marriage is null and void.
My last marriage was like this, but I found out only after I had already filed for divorce. It was too late to make much more of a change then what I already did.
This person will be placed in jail, therefore, she will have no rights if you bring this matter up before a judge. Your son will be in your custody because of this. You will have more ability to make decisions as to the split-up.
Does the other husband know? Is he divorcing her as well? These are also matters to consider.

I was a little confused by the question in that I couldn't determine if your spouse was married to you first or the other man first. In any event, in my state, the second marriage is null and void because a married person cannot legally marry another. In other words, it did not happen despite the marriage license. In some states, the second marriage is voidable, not void, meaning that you have go through a procedure to void the second marriage. Hope this helps and good luck to you and your child.

Welllet me sa that this happened to me....Check this with an attorney. The person that was your wife first married is what will be recongnized as your marriage. The date and time are important. Should she die then your marriage to her would be what a court upholds. Th other marriage is bigamy... so let say that you are retired and you were married long enough to qualify for Social Security Benies,they wluld have to go to you before they could go to the other spouse as he is not got his marriage recongnized by the state and he would of lied when he signed under oath for the marraige license. By the way you can press charges. see a lawyer about it!

That's a good idea to hire an attorney and to prove she is a bigamist, which is illegal.
Fight to get your legal custody of your son, she was an adulterer and a bigamist and that's no role model for a child's mother.

You were never legally married to this woman. Did she ever tell you that she was still married when she agreed to marry you? I would get a lawyer and sue for misrepresentation. I would also sue for custodial custody of the child. Go after everything you can.

Polygamy is against the law in most states. You should have no trouble getting custody of your son and should not have to pay alimony. In fact, she could go to jail. At the very least you have adultery in your favor. It really doesn't matter when she got married as long as you were first. I believe another name for this is Bigomy. This is illegal. You also need to get child support along with custody.

You should get custody of the kids because she cant be with another man until your divorce is finalized, legally.

so she maried you while still married? Well I cant say anything to ease your pain, but shes going to have seek a good lawyer, and maybe your marriage wasnt legal so you might not need a divorce but she will be in big trouble........

This is terrible. If she married you first then your marriage to her is legitmate. If she married you second then it's not valid. She is a bigamist. You definately need to seek legal representation. I feel sorry for you. God Bless.
