After watching an intense basketball game at a sportsbar this person pats a stranger's behind in a "good game" gesture. The kind of gesture you see on TV all the time during basketball games. The stranger pressed charges of Sexual Assault which were eventually dropped but now is filing charges of battery. Should the accused get an attorney? Do you think the charges will stick?

Is this a criminal case or a civil one? I'm assuming it's civil, because it seems unlikely that the police would take any action with respect to this sort of thing (unless there is an unbiased witness or two who can back it up).

A battery is an unwanted touching. So, technically, I believe that the stranger could legitimately sue. Whether he/she could recover is another story. For one thing, I think he/she would have to show how he/she has been damaged as a result of the pat (for example, suffered some significant emotional trauma that kept him/her out of work).

Based on your description, I'd guess that the stranger will not prevail.

The victim of the pat could not have pressed charges for Sex Assault, the victim isn't the one to determine the charges and no police officer would have made an arrest nor a DA filed such charges on their behalf. This story just doesn't ring true. Sex Assault is legalese for rape anyway, this would be considered "simple" assault at most.

Why would you pat a strangers butt anyway? I don't want anyone grabbing my @$$ unless she is hot. Sounds like some pervert getting his jollies and trying to pass it off as a "good game pat."

Hell, I play several sports and none of my teamates grope each other.

It is not wise to pat a stranger of the opposite sex on the bottom for any reason, I hope that the law gives him what he deserves for his inappropriate actions. Don't even pat a male stranger on the bottom , you won't end up in court, you will most likely end up in the hospital.

I think you're allowed to give your teammates "good game" pats on the butt, but not strangers in sports bars.

You see the players do it on TV, right, not the strangers sitting next to each other in the stands? High-fives I'm willing to let slide, but please don't ever pat my butt if we're not already WELL-acquainted.

*grins* An Australian got busted in Texas because she put her hand on this woman's shoulder (to try to get her attention because she was talking in the movies). She was being charged with disorderly conduct and I believe she had to pay a $200 fine. Make of that what you will.

Well if the "receiver" is taking any kind of court action yes the giver needs an attorney or at least the advise of one.
