Both of our names are on the title. I currently have a lawyer.
my lawyer is gonna partition him to sell the house. I think he will
destroy it once he finds out what im doing. If he destroys it, can I file any civil action against him or have him arrested?

ever hear of insurance? get some if you don't have any, and file a restraining order against him for the property.

People wonder why I preach so hard against shacking up with out being married, and this is why.

Can't you just sell your half to your ex? Or just have your name taken off the deed? That's what I would do, and not bother getting any money back. Just chalk it up to an expensive life lesson. If he destroys it, he'll be arrested for arson, and get about 20 years. You can file a civil suit, but with him not working for the next 20 years, you won't get a dime.

Not sure if you can stop someone from doing something if they're that angry and intent upon doing it. That being said, you can protect yourself by taking tons and tons of pictures of the house before something bad happens to it.

You'd have to consult your attorney about the potential for civil action or arrest if he does damage the property.

Sounds like you getting out is a good thing; especially if he has such anger issues. Good luck.

check with your local police to see if they have laws against damaging property that is in your/his name.
some areas have laws that state you can do with is as you please, others don't.
also check with your lawyer about it. most of the time if the courts say don't do anything till it's settled via mediation or otherwise he can't touch anything... like in a divorce.
if he damages your property, things in your name solely, that's a different story and the police might make a report for the criminal mischief. or they might tell you that's something civil too and to add that to your lawsuit.
anyway you look at it... never put something in both your names unless married... even then you run the risk of civil legalities.

if he has no money a judgement is no good.

does he have money in the bank?

ask your lawyer to speed up the process if possible.
