I ask because my roomate got us evicted for not paying rent on time...they said I could 'pay the months rent or vacate premises within 3 days) however he doesn't have the rent money....do we have to pay that months rent late if we just leave ? My lease was up on 31st anyway (so Idk why they would want us to leave 15 days early)

I got married and moved with husband, signed off lease which is up on 7/31 (paid xtra to break it earlier than my original date) roomate was to pay the months rent...he did not (was not on lease either) I wont be able to pay them until end of month. They put a notice saying if I dont pay then I have to move out by the 11th. I dont think I should have to pay AND move my stuff out earlier than expected.

First, he can't give you a 3 day notice to evict and charge you for the entire month. He must give you a 30 day notice and the eviction isn't technically a legal process until he goes through the court.

You are permitted to stay, for every day that you pay for.

So, if your lease was up on the 31st, you are welcome to stay until the 31st, but you also have to pay.

However, IF you decide to vacate in 3 days, get it in writing from him that he has evicted you, pay through the last day you were there, and by you graciously conforming to his request, he has just barred himself for collecting rent through the end of the month.

He can't have his cake and eat it too. He can't charge you through the end of the month, get a new tenant in the same month, and double-collect rent...because that is EXACTLY what he is trying to do.

Hi,
My advice is pay that rent ASAP. You don't want this on your record. If you ever want to rent within the next several years I'd pay it before you are legally evicted.

if your not behind by law in most states it is 30 days, also is he on the lease? when you moved in did you guys pay last months rent? you didnt provide enough detail.. but you should start by contacting the housing court ..dont move till you speak to them

yes you will still be responsible for paying for that month and the eviction will go on your credit even though your leads was up in 15 days it will be hard to get another apartment unless you get one before it shows on your credit and they will be able to report that you still owe them the amount of last months rent?

If I were getting evicted I most surely wouldn't pay them up. Why ? they're kicking you out.
