me and my girlfriend work for the same company in different departments and we have a problem with our boss , firstly he said we couldnt take holiday at the same time even tho there was cover available then when i mentioned looking into the legal side he said we had to take any holiday we wanted before july so we took our holidays together we now have 9mths before we can take holiday together again ...ontop of this he has also been slagging my girlfriend off on a personal level to me and other employees.
we dont know what we can do as this bloke also sexually harrases polish staff and past employees have left because of this he gets away with anything even when problems are reported they dont not get taken seriously by this huge worldwide company at all ... what can we do ???

1.) Join a union if you are not already a member and get other staff to do so too.

2.) You can initiate a grievance against your employer if you feel he is being unreasonable concerning the allocation of annual leave (although you have no legal right to take your holidays when you wish).

3.) Concerning the comments regarding your girlfriend - I think initially he needs to be told that you find such comments unacceptable and that if this happens again you will be making a formal complaint to senior management.

4.) If you feel complaints against this man are not being taken seriously, then again, another reason to be part of a union. Formal grievances and complaints are far more likely to be successful if they are initiated on behalf of a group of workers rather than an individual.

ok, Firstly what I would do in your situation is find out as much information you can on whether or not you will be able to get a case about what the boss is doing.

unfortunetly you can not do anything about him sexually harrasing the polish in the work place yourself, they themselves need to come forward.

then, write down the day,time and what the conversation is everything time something happens, even take a pocket recorder and record conversations you need as much hard proof as you can. try and get proper witnesses. after that I strongly suggest you to write to the managing director of the company and at the same time join a union. unions won't do anything without you talking to the higher people in the company. if that doesn't have any desired affect then get the union involved. it may be worth finding out whether your company have a internal union rep. and if absolutely necessary take it further with a solicitor.

A couple of things:

Firstly, unless it is written into the employment contract, including subsequent amendments, that holidays must be taken before July then that is utter nonsense.

Secondly, if this company is as big as you say it is, it would be stupid to ignore a collective complaint by members of staff. Therefore, my suggestion is that a letter of complaint be sent to the Company Secretary signed by several staff members, the more the merrier.

Thirdly, it sounds like one or both of you has a case for constructive dismissal should either of you decide to leave. Put that into the letter to the Company Secretary, it could cost the firm thousands in compensation.

you said you two work in different departments but you didn't mention the titles of your jobs, i.e. if one of you had a higher title than the other (which might be the problem). You want to know what can you do, well I'm in the US and I suspect you aren't. Here we would probably leave their employ, either one or both. And, maybe one day catch him in doing something illegal and press charges. I don't recall your saying how large the company is and small or medium size there could be nepotism in that company so no matter what he does he will not get fired. You said "other employes left"...so, follow their lead.

The first thing you should do is put your greivance in writing to your human resources manager. This should initiate a meeting where you, your girlfriend and your boss can discuss your greivances and a decision should then be made as to how to move forward.
You should ensure that your greivance is taken seriously by making notes of dates, times and what your boss says and does the things you accuse him of in your question.
Hopefully you will make him understand that the whole business is upsetting both you and your girlfriend.

In reference to slagging you off this is known as defamation of character and unfortunately i have forgotten the name of the Legislation but, go into your search engine and type in defamation of character legislation. Next look up the Legislation at
www.opsi.gov.uk/ and click onto Legislation [public acts] and then click onto the appropiate links.In reference to sexual harassment go to www.eoc.org.uk/ and also
www.yourrights.org.uk/ and Finally to find out if your employer has been in front of a Court of Law for the complaints you have mentioned go to www.bailli.org/ and click onto Case Law. You will see the different Courts. Type in the name of your firm and you will find out if it has been in front of the Court
You will have to go through the different courts to be sure of an answer. This will take a minimum of 2 hours to do it properly.

as a boss myself, i find this person's attitude wrong, and he shouldn't have the position if he can't behave. If you were my staff i would inform you that sometimes you can't have holiday together but i would always try to meet you both in the middle which he isn't. as for the comments you can take a grievance out on him, which would be investigate by his boss. personally, quite frankly he deserves a kick in the backside, he needs to be taken down, but you need to do it through the correct procedures.

As someone has aid if a large company join the union otherwise leave and make a formal complaint in your leaving interview

Make a written complaint to the HR department...
keep your copies ....If the HR dont do anything go to Employment tribunal
Mention the bit about feeling discriminated due to your nationality- Polish in your letter to HR.. In the UK European citizens have better rights .......Dont be scared...
Check your job prospects in case it gets nasty...

Write a letter to head office and get all the people who feel aggrieved by this idiot to sign it and the they will have to listen and take action. If this fails wait for him in the car park after work and give him a really good kick-in.
