i would like to know on a legal sense how high should a tree & it branches be from the roadway as i have had damage to my tractor trailer done by a tree branch as i was proceeding to go up this street in oh i been looking on the websites for reference to this as i am now down because of this major damage to my box after a very large branch smash on to it and the city it happened in tell me it is up to the property owner but i need to know what high should these branches be from roadway surface HELP !!

It depends on the street and whether it is a commercial area you are going in or a street that is a residence. This is governed by zoning in the area where the tree is so call the local building and zoning folks and they should be able to tell you. Generally if it is a commercial area (think a small highway, etc.) no trees are allowed to overhang the streets but in residential areas (r-1 or r-2 rated areas) communities can decide to close the road to tractor trailers and/or elect to have a tree canopy. Have to call the zoning or utility people in your area (those who maintain the utility lines can force someone to cut back their trees if it is in the power or phone lines).

It depends on where it occurred. The jurisdiction that the street belongs to is what determines the height. Some jurisdictions have NO requirements.
