My friend just asked for a divorce. His spouse immediately cleaned out their joint accounts! What should be taken care of right away? (i.e. other accounts, creditors) He is filing divorce papers in in three days.

get the amounts that was withdrawn from the accounts,
GET A GOOD ATTY< ASAP>
Look for copies of bank statements, and go to the bank if necessary and ask them to print the last couple months, and have him get a credit report on her for all her financial information. so it can be reported in court when the ATtY get's in volved. This will disclose if credit has been granted in his name that he does not know about. and can be brought up in court.,
Especially get the Credit cards. cancel, and find if any new accounts have been open jointly these cards will be in his name and make him Liabable. you have, and get a payofff if necessary, so she cannot max out the cards, although I'm willing to bet she already has if she cleaned out the accounts already.
Suggest he open a new account in his name with the children in "TRUST" to prevent her from access to the account.

Then have him sit down and talk to any children if there old enough and let them know that He loves, them dearly, but he and momma are not getting along, and that he is NOT leaving their life, but he does have to leave momma so they don;t suffer.

Your friend needs to find an attorney fast. He needs to keep his bank statement showing she took the money, so he can prove to the judge that he is entitled to an equal sum when it comes to dividing community property. Anything he can liquidate for cash needs to be done before he files for divorce because once it is filed he nor she can sell, destroy or give away any of the community property. All assets are frozen until a community property is settled. Change the locks on all of the doors. Cancel any credit cards she has access to. If she has a cell phone cancel it. Immediately move all assets and money to another account just in his name so it is unaccessable to her. Good Luck

He SHOULD have filed for divorce without asking. One doesn't NEED to ask their spouse for divorce, one doesn't NEED permission to file for divorce. He set himself up to get screwed. I suggest he file divorce papers now because in three days she can max out all credit cards and bank accounts and if she knows his social security can open accounts in his name with it and max those out and HE will be liable for all payments. If one is going to file for divorce DON'T ASK YOUR FUTURE EX SPOUSE FOR PERMISSION

Oh man! He didn't handle that very well. He should cancel all credit cards and accounts in his name, or at least have the companies put holds on those accounts.

LOL...she beat him to it. Chalk it up to experience for his next divorce.

He should really freeze all credit cards.

It's a run for the bank! He hurt her and she got him back! It's a big mistake on his part but legal there's nothing he can do it was all legit

Tell him to talk to his lawyer. FYI, she didn't do anything wrong, it was her money too.
