my dad and my stepmom are getting a divorce. they have been married for 7 years, and have no children together. My dad has 3 kids of his own from his previous marriage and he makes a good living. My stepmother used to work at a low income job (didnt contribute much to the household) but later quit and now has no job. How much of my dad's money will my stepmom walk away with (percentage)?????

she didnt sign a pre-nup and we have a maid so she does minimal cleaning

I love Texas!

Alimony will kick you in the butt. Hey, your dad chose her. Too bad for him.

I guess I don't have a real answer for you...sorry. Call the Texas Hammer - Wayne Wright...ever seen his commercials? They crack me up.

Half. Texas is a community property state. Contrary to popular belief, staying at home is work also. Consider how much you'd have to pay someone to come in and clean, cook and do laundry. She's put her time in, she's entitled to her half.

I don't believe Texas has alimony unless you've been married over 10 years.

She can expect alimony for half the length of the marriage and half of whatever he accumulated from the time of the marriage until the date of separation. That means:

7 years ago:
House- $200,000
Savings - $50,000
Retirement- $50,000
Cars/Boats- $50,000
Total - $350,000

Now:
House- $300,000
Savings- $100,000
Retirement- $100,000
Cars/Boats- $50,000
Sub-Total - $550,000
Minus original value- $350,000
Total - $200,000

Chances are, in addition to alimony, she will get half of that $200,000. There are variables, of course. If she cheated, she may get less; if your father cheated, she may get more. He may opt to give her more to go away. She may take less to just get out of the marriage.

In short, your dad needs a good lawyer.

Forget the prenup as it no good in most courts anyway. Texas is a common law state where everything is split 50/50 but each state has its own formula for determining spousaland child support ,if applicable
