I was on cash assistance 3 years ago because my ex-husband wasn't paying his child support and I was going to college so I could get a better job and support my 3 kids. He always worked under the table so he never filed his taxes. Now, for the first time he files his taxes and I was suppose to get $3600 for back support. I never got it because it went to welfare from the cash assistance I got 3 years ago. Is this fair? He still owes me over $4000 in child support. I have been working and off of welfare since I graduated college in 2004.

no. people claim that interests of the children come first in the courts views. This shows the government puts their interests above that of the children. you may eventually get yours, but the government gives themselves priority.

The way welfare works is : if you get any kind of cash assistance they are only suppose to take back the amount that they gave you from you arrears of child support. This is due to if you were getting the child support then you would not have needed the cash assistance from them. It's like a loan.I do know that they sometimes take more then what they gave you. That is not fair. They have done that to me in the past.

Wow, these people are pretty rough. I think that assistance should go to people like you rather than to people who get pregnant time and time again without ever being married to any of the fathers. What they gave you years ago was to take the place of what your husband owed you back then. As soon as he becomes solvent the government will reclaim their part even if he still owes you money. You now need to go after him for the $4,000 plus interest. Good luck.

When a marriage end, sometimes people get hurt. My parents divored after 17 years of marriage and left my mom with4 kids in the early1960's.My mom only got about 2 support checks from my dad.She could never get any money out of him at all.In those days he was to give $40.00 a month for 4 kids. Even in those days that was nothing. She even got him thrown into jail once for non payment. She worked full-time and we never got state assistance. It isn't easy but what can you do? be strong...

Hell yes it's fair, you received money and now it is time to pay it back. The state didn't force you to laydown and make the babies, so why should they pay to care for them.

Your children's father owes you $4000.00, not the government.

If you were aware that this guy was not reporting his income, it should have been reported.
