My fiance has 2 children from a previous marriage & her ex is behind a month & a half thus far & the sad thing is, he's only paying 500 a month for two kids.

and he just started working for his self in Jan. so they don't take it straight out of his check like they use to & he's already behind. Like we figured.

She needs to contact the equivalent of the Division of Child Support Enforcement in her State, to find out what the limitations are. They should be able to file a petition for arrears on the case and have it brought in for a hearing.

I live in NC and have a child support case as well. There should be no "getting behind". Each county has it's own way of handling the matter but your fiancee will have to be quite aggressive in dealing with the child support enforcement agency for her county. Like most state jobs they have a huge caseload and as the saying goes the squeaky wheel gets the oil. Your posting did not indicate whether or not it was being handled by child support enforcement already. If it is not then she should schedule an appointment to go in and set up an appointment with a worker. They will take all the information and will be able to verify his income through the employment security commission and according to their worksheet will draw up an amount he will be ordered to pay (so she may even get an increase). They will also make his order subject to income withholding so as long as he is employed she will receive her child support. NC takes child support very seriously and you can lose your license, the debt can be reported to the credit bureau, and frequently people go to jail for non-payment. It takes alot longer than that, my sister is going through the same thing and it's been a year now and dude still hasn't paid up, so it come take a while. Tell her to stay on their backs til they finally help her.

as long as your girlfriend does not sue for back child support. He is free as a bird. She needs to have the court collect her child support to avoid late payments/ He will have to comply or he will go to jail....
Have her find his address, phone numbers and all relatives living close by...The police will go after him.....North Carolina, laws

NC lets them get as far behind as they like. My ex husband Timothy Arnold Sanders is over one hundred seven thousand and still he doesnt pay it

He is not legally allowed to get behind at all. Your finace needs to go to court, get the child support raised to 750.00 per month, and if he doesn't pay, then garnish his wages. No ifs, ands, or buts about this.
