You need to contact the Court in your State that handles these issues. In Delaware it is Family Court and they have a site on-line that has the papers there to be downloaded, filled in and submitted. You need to find the equivalent for your State.

You know what. The best way to go about this is to get a lawyers advice on how to do this correctly, even if they can show you. My soon-to-be ex filed for divorce in March of 06 and I decided to go Pro-Se because we had nothing to divide nor did he contest. I was separated from him for 11yrs!! In July of 06 I had to retain a lawyer (especially if he/she has an attorney) cause the court can twist alot of things and you will have to know the lawyer lingo in order to make it right. I decided to not accept child support from him and told the judge that. Now the State decided to file child support against him and I had to pay $1,600 for an attorney and now they are still fighting it out and Im not divorced yet, and my attorney wants me to pay an additional 1200. Everything was agreed on and we are not fighting. So Im still (almost 1yr 6mos) not done, and I thought it would be the easiest to get rid of. So just make sure you get all the legal help you can get. Make sure all the wording is right and if you are due anything, MAKE SURE ITS IN THE DECREE!!!!
Even if you want him to come an empty the trash every Wednesday, make sure its in the decree, cause trust me, it can come back to haunt you. Good Luck!!!! P.S. Just a word of advice. Just because it may seem smooth now, when he/she gets those papers, everything changes.

if you are in canada go to the court house and make application. a clerk there will help you with the papers.. there is a fee for filing. you need copy of marriage certificate and then once you get papers,you fill them out and you both have to sign. then papers are returned to court and they set a date for court.
there is a 285.00 filing fee.
you do not require lawyers....
the judgement is granted and you gte a decree nisci then 30 days later you get a decree absolute... then you are totally free...

Get onto the state website of the state you are in. Usually you can just print them out or they can tell you how to get them. each state has different papers, so you must get it from the state where you a filing.

contact your local circuit clerk, some already have the papers in a fill in the blank form (petition for dissolution of marriage) and they also would have the order as well...you fill them out...take them both back with your (ex) and both sign in front of them or a notary...and pay the filing fee (it isn't normally alot) where I live it is around $60.00/$100.00 they will give you a court date and you appear before the judge....

Whatever state you're in, you can actually go to the courts website and download the papers from there.

My sister went to the court house and got the papers and filed herself and it only cost her $100.00 for everything. She said it was easy and the papers were self explanatory.
