Who can give the public any idea as to why....the Mccann's haven't been taken to task at least about leaving their children???? please give us some reasonable, lawful insight.
Is it because they're professionals? because they've made such headlines?

I'm seriously intersted........ it might help put some of the concerns on this forum to rest...I know you won't be able to give specifics but as a rule of thumb so to speak...

Because to do so there has to be a decision made by the cown prosecution service that it would "be in the public interest" to prosecute. Lets be honest whatever people may think about the decision that they made on that night, is it now going to be in anyones interest for them to be prosecuted for it? I dont think so do you.
"Wake up"- I am a solicitor in private practice and have been a defence lawyer for 15 years. Not prosecuting the Mcanns has no effect whatsoever on future prosecutions. The fact that the Mcanns were not prosecuted cannot ever be a defence to anothers prosecution. I went for the public interest line but any prosecutor would know for certain that there is no realistic chance of a conviction. Lets put it this way if I had to defend this case ( if ever brought) then I would immediately get the defendants to elect crown court trial. To secure a conviction you have then got to get at least 10 members of the jury to vote guilty. It is not going to happen.
What further punishment should they receive anyway? As a father as well as a lawyer surely the absolute hell they must be going through is punishment enough. In addition to all of this there is the little difficulty of all of this happening in a foreign jurisdiction in any event.

Leading lawyer - why do you think it wouldn't be in the public interest to prosecute? What about the precedent not prosecuting the McCanns will set for future cases that are brought for child neglect? Don't you honestly think it gravely reduces the chances of successful convictions in the future? Any defence lawyer worth his salt would be tempted to use the McCanns' non-prosecution as a defence.

Edit: Leading lawyer - thanks for the explanation. I strongly feel there is more to this case than meets the eye. I rather suspect the Portuguese police think Gerry McCann is involved but are currently lacking sufficient evidence. It looks likely there may be significant developments in their enquiry in the next week or so - we shall see.
