My friend was recently accused of suspected sexual harrassement, he was arrested and bailed while investigation took place, there was no proof, no witnesses just a little sexual bantering went on that this women took the wrong way and "cried rape". No further action was the result by the police but throughout his whole ordel he was suspended for a while, all his work friends obviously knew and ruined his self confidence and respect and the woman that did this is still working in the same company and dropped all charges as she knew she had taken it all too far. Can my friend sue her for all what she has put him through.

ANYONE CAN SUE ANYONE. IT IS WINNING THE CASE THAT COUNTS.

HE WOULD BE BETTER OFF JUST TO DROP THE WHOLE THING. SHAKE IT OFF AND TAKE THE HIGH ROAD.

O.K. first this poster HAS an attorney listening to his friend's plight. Why do you think I asked him the question I did.

Secondly, the salient point of the post is "...that this women took the wrong way and 'cried rape'". That is very telling. In a sexual harassment case, the ONLY requirement to substantiate such a charge is that the target of the attempt perceive it as harassment.

It doesn't matter if the offender THINKS she took it the wrong way or not.

As for can he sue, sure he can. And it won't get past the motion phase unless the offender wants to commit perjury and deny making any sort of statement to the victin that was 'taken the wrong way'.

There is no case here period.

Absolutely and he should sue. people like that just make it worse for the rest of us. Slander however, is bsically another word for insult, not sure if that's the right thing. There are others tho, like making a false accusation, suing for compensation of finacial loss, pain and suffering. I'm sorry to say (because I think it's horrible what the woman did to your friend) this would not be considered a major issue in court. So your friend should do a little research, talk to a lawyer and see what his options are.

Yes, he can. But he needs to get an attorney. A consultation is free usually.

Many companies have policies that a person who is found to have made fraudulent statements when claiming sexual harrassment can get disciplined. He can check the policy book on that and ask some questions.

Yes he certainly can, but will not get legal aid, so will have to be prepared to pay and it will prove to be costly.
