We are moving out in Sept and my landlords are AHOLES so I am making sure I am covering my butt if you know what I mean... what do you reccomend I do to get my deposit back - both before and after we move out?

My land lord has already stated *if* he has to replace the carpet it would cost 3000 dollars.

We have had 2 people here to inspect the place since we lived here and while one was a problem, the follow up claimed there was nothing wrong with the place and it is in good condition.

I think that the land lord is out to get our money as our deposit was 2600 - (yes this was the whole deposit - not including the rent... and it is including the pet deposit of 500 which is supposed to be refundable. )

Any suggestions?

Video tape the whole place. Make sure it day and time dates it's self and shows on the screen. You use this to take them to court later. That is a large deposit and so is the pet fee.

Make sure they know your new address, otherwise it could delay your refund.

I have had an awful incident with BAD landlords. Some will try anything to keep your deposit. It is best when you move in to a new place to take pictures of EVERYTHING that is wrong or just the general condition b4 you move ne thing in. Then also take pictures of what the place looks like after youve moved. I dont know your landlord so I cant say specifically.....but I would have the carpets cleaned as well as the whole place by professionals, may cost a couple hundred dollars, but would be a good investment for such a large deposit. And the pictures are also good if you have to go to small claims court to show how you left the place when you moved. Good Luck with this.

You will most likely have to take the landlord to small claims court to get you deposit refunded so before you move begin gathering evidence. Clean the apartment totally floor to ceiling, inside and out. Take pictures, make a video, have a non-relative do a walk through so they can go to court as your witness AND get the landlord to do a walk through before you return the keys. If you have enough time have the apartment ready for the landlord walk through a few days before your lease term is up. Ask the landlord if there are any problems, have him put the answer in writting. If he says there are problems and you have given yourself enough time you can fix the problems. Make sure you ask him to sign off and have your witness with you in case he refuses to do that.

You can probably kiss goodbye to the pet deposit portion of your $2600, especially if there is any hint of pet odor in the property when you vacate. If it takes replacement of the carpet to eliminate the pet odors, the rest of it is gone as well.

You do not state what type of pet you have here. However, I CAN tell you with certainty that it is acceptable for the landlord to replace the carpeting at your expense if there are odors in the carpeting which shampooing cannot remove.

The carpet may LOOK perfect, but odors from pets are not considered normal wear and tear. I've had to do this on more than one occasion with tenants which had pets.

More then likely you will have to take the landlord to small claims court...as we did to get our deposit back! Clean the apartment and paint if needed. And make a video,as we did. When we got to court and she saw us pull out the video....she backed down and we got our deposit. Please do not let the jerk get away with it....or he/she will keep doing it to new renters!
