The question relates to the huge cases pending in courts.

The best course in avoiding legal suits in the court is by settling the issue out of court by either mutual agreement on terms & conditions suitable to the parties or by simple Arbitration that is agreed by them. Now one cannot say there will not be any dispute between the parties in any relationship, whether it is a commercial, domestic, or any form of public dealing amongst the people but if these disputes are disposed off out of court settlement then obviously the burden of civil matters will reduce which are pending in a wholesome manner in Indian courts. In order to reduce the petty civil matters relating to the commercial agreements & transactions the Government enacted the Consumer Protection Act, 1986 but see the number of such consumer disputes in the consumer forums have already over taken the civil court cases, as now for any small matter a person wants to go in the consumer forum rather then settling the issue by mutual settlement. Same one sees in the domestic cases mainly relating to marriage & divorce. Any couple not having good matrimonial relationship with each other rather then settling this issue amongst themselves for moving for divorce by mutual consent (after settling the issue of custody of children & maintenance/alimony themselves) in a family court rather wants to go the longer way . The wife will go around filing criminal complaints against the husband under section 498A of the Indian Penal Code, Dowry Prohibition Act, Protection of Women from Domestic Violence Act & husband will go filling unilateral case for Divorce on the ground of cruelty & desertion etc. All such things increase the files in the courts & delay of the real issue in dispute. It is the professional duty of the lawyers/advocates & other law enforcing officer concerned in such cases to guide the disputed people to go in for mutual agreement & settlement out of court rather entering courts in all such matters. The organizations concerned in the welfare of any such people who indulge in dispute should do the same, rather all these people I pointed out here are more concerned in their own benefits that they will make out of the court cases, without realizing the burden of such matters only amounts to mere wastage of money, time & energy of every one.

people should take accountability for their own actions and quit filing frivolous lawsuits. and trust me, i've seen a few in my own office! here's an example of ridiculous-a woman in Seminole County, Florida, tripped on a pinecone in the parking lot of the courthouse and is suing the city/county for her injuries. yes that's right folks. a PINECONE. fortunately, its not one of our cases. i don't know the outcome or if there was one yet. you can only hope for a smart jury.

of course another issue is crime. not sure how to curb it. but that would ease the dockets if they would get tougher on crime and stop release people b/c the jails are overcrowded. so what? don't make it nice for people in jail!
