I basically just threw in a set of MP3 files on a CD that went along with the book, except I burned them for the users convenience. The listing was promptly removed, I learned my lesson, and NO TRANSACTION whatsoever was made with anyone. The CD's were not even going to be burned until someone had bought the books. The company is now emailing me and threatening to take legal action if I do not pay for the price of the CD's (which I already purchased legally) and send an appology letter etc. I was wondering have I commited any kind of crime by doing all this? Remember no transaction was made. I am worried that if I send an appology I am admitting that I have done something that I haven't and that will lead to worse problems.

Personally, I would ignore them. Don't send an appology. But that's just my opinion, I don't know everything that went on. I wouldn't give them a dime unless ordered to by the courts, and I don't think they will take it that far. Record companies are BS!

If you would have actually sold a book and provided a CD then you would have committed a crime. Since you did not no crime was committed. As for the drug dealing analogy that is a criminal offense this is a civil offense, apples and oranges. Do not reapond to the letter if they want they can take you to civil court and there they have to prove how they were harmed by your actions, which as I understand it will be difficult since you never distributed copy right material, and merely having the intent to distribute copy righted material is not a crime only actually distributing the material is.

The crime was committed when you offered the CD. Picture this: You go up to a police officer. You pull out a bad of pot and say "I'll sell you this for $10". You can bet that you will get busted for possession with the intent to distribute even though the transaction never took place.

What you should do is contact them, tell them you weren't aware of the illegality of it, that you hadn't made any CD's but would have only if your items were purchased.

Tell them you are very sorry, have learned your lesson and will NEVER do it again.
