Well actually it was my car, but my husband was driving . There was an on scene police report and the cop told my husband that it was the others fault. Now I have been receiving letters from their insurance company saying that we owe them and if we don't pay for their damages we will be sued.

call your insurance company. that is why you pay them the big bucks. They not only repair your car, they defend you if somebody sues you. and believe me, the insurance companies like to go after one another, especially if they think the other insurance company is trying to pull a fast one on their client. They even have a word for it. it is called subrogation.
do not respond to the other driver's insurance company. just send copies of all correspondence to your company.

Ok, suing people costs money so do lawyers. I would first contact your insurance agency, they should help a little bit. Make two copies of the police report and send one to their insurance, and one to the other party. If they still are threatening you, you can always find a lawyer for free legal advice. If you are taken to court. You dont HAVE to have a lawyer, just be prepared to defend yourself. First of all, if you were in the vehicle, you will be a witness, your husband will have to do most of the talking. Be sure to bring your original copy of the police report, any pictures that were taken, as well as ask the on-scene officer to be present at the hearing in your defense.

Yes, standard tactic to defend an insurance client by claiming the other party was at fault and threatening to sue. If they had a case (which they know or will know they don't) they would sue and you would win, so just be ready to hire an attorney to draft a scathing demurrer and motion to dismiss.

Anybody can be sued. Whether they win or not is a different story. As suggest, get a lawyer. Do not send a copy of the accident to their lawyer. If you could avoid notifing your insurance co, that would be find because whether it was your fault or not, they could find a way to raise your rates.

They're trying to scare you to get money. Send them a copy of the police report and a note stating that the officer told you it wasn't your fault, so you have no intention of paying them.

Counter Sue. if the report really says it their fault and you can have the cop testifie then counter sue their ***. looks like someone is getting a new car!

Get a lawyer and let him fight it out for you. If you have a police report and didnt get the ticket then there is all the proof you need.
