I recently moved out of the dorms at my school and was fined for nail holes/ paint damage and im not certain to which one they are charging me for... I believe that this is a scam because at the beginning when i moved in they have you fill out a damage report prior to moving in so you wont be charged for damage caused by prior residents...this report says that there has been a room inspection prior to me moving in..so i didnt feel that it was necessary to report every hole or paint damage due to the fact that the reports states that all damage has been already recorded...what should I say to help me win this case and not be fined 63.00 dollars? Please Help? examples welcome!!!!!!!!

Depending on the damages you can claim normal wear and tear on the paint which normally would preclude you from having to pay for the repairs.. But you need to look at the agreement you signed with the university..

Realistically the person you will be appealing to is a real person and you can just explain the situation sometimes it helps to go see them other times they don't care. But if you are appealing just explain it politely and go from there. As a former RA i have seen this from both sides of the fence and have seen successful appeals from someone that I know did the damage and unsuccessful from those that just didn't fill out the form at the beginning of the year.

But in the end I think the 1st person is correct.. This might need to be chalked up to a 63.00 dollar lesson. Do the forms when you get them to keep it from biting you in the bottom/wallet when the end of the year comes... As well document everything (pictures are great.) When you move in if there is damage take pictures of it.. soo at the end of the year they can't really argue with you.

You're not gonna like this answer, but even though they stated that the damages had been recorded, it is still your responsibility to report them. I work maintenance at a university and we run into this situation all the time. However, if you want to about trying to get it taken care of, the first thing you should do is try to talk to the dorm director/head resident or whoever is in charge of the dorm you lived in. If that doesn't work, you can always try to speak with residence life, or whoever is in charge there. I always make it a point to speak to them in person if possible. A letter is good, but if they see you in person, it shows that it is important to you. I know cause I've had to appeal a few things is my college career as well. But, if it doesn't work it, take it as a lesson. Even in college, you can't rely on someone else's word about an issue like this.

It's probably not every hole. If you report X number of holes, they are charging you with the remaining holes and damage.

Before you go on, look at what evidence you have to support your claim: do you have pictures of the walls before you moved in and after you moved out? What PROOF do you have to improve your chances of winning? You'll need more than just friends saying that.

If you don't, then I wouldn't fight this battle. You need more than to just say "I wrote everything down..." To win this case, you need to PROVE that the damage you are being charged for was left behind.

Write up what you wrote here in business letter format, have someone with good writing skills proofread it, then send it to your school with a copy of the room inspection report attached. State that you did not create any new nail holes or damage any of the paint and that you will not pay them the $63. Note: Your school's legal services office will not help you b/c they won't go against the school.
