Anyone who had the number 42 before it was retired is grandfathered in and allowed to wear it for the remainder of their career.

Any player that was wearing the # prior to it being officially retired by MLB, got to continue wearing it. Mariano fell into this category.

Once he is retired, no player will get to wear 42. The Yankees will be the only team to retire 42 for someone other than Jackie, as I am sure Mo will most certainly have it retired by the Yankees.

Anyone already wearing #42 on the day MLB announced the retirement -- 15-April-1947, the 50th anniversary of Jackie's debut -- was allowed to continue wearing it if they so chose. Rivera is the last such player still active.

Same reason Mo Vaughn was able to wear it until he retired. They retired it for any new players, but the ones who were currently (at the time) wearing the #42 were able to keep the number until they retired or changed it on their own.
