I have sort of a complicated situation. I have a very ungreatful xgirlfriend. Aprox in december 06 my x girlfreind was wining she wanted a pug puppy. I had some extra money, so i said i can go buy the dog cash right now but you got to help me with some of my bills this month, She said fine. I paid 600.00 for the dog and bought it cash on the spot. To make a very long story short on april 25th i put a restraining order against her,threw her out of the house. When we went to court i agreed she can have the dog as long as i am paid back and she comes to the house via third party to retrieve the dog, she agreed to her brother. I moved out of her and i shared apt on may 9th as i recentley bought a house. According to the court order she was suppost to come back to the shared apartment to retrieve the puppy or have her brother retrieve the puppy. On may 11th i called her brother, He said he can not get ahold of her. He is a otr truck driver and clearley can not keep a dog. I asked him where is the dog? He stated he has no idea. I called my neighbor and he said she has not been back yet. So i had no other choice to go to the apt and take the dog. It was 3 days after i moved out and yet no one had been there. I just could not let a 5 month old puppy die. So i took the dog. On may 27 (yes almost one month later) my x txt messaged me and said she wanted the dog. She had not been home in a month, if i didnt take the dog she would have died. I in turn told her no im keeping the dog for her safety as my x has a drinking problem and a drug problem at this point. In return i got bombarded with false police reports harrassment claims etc by her. In toatil she tried calling the cops on me 12 times. Nothing ever came of any of it. At this point i have just had it and asked if i could have the akc papers signed over to me. She replied using harsh language to say the least. I so far have sent a registered letter with the akc paperwork being ignored. At this point i simpley want her to sogn the puppy into my name as for months i have been caring for it she has never again tried to get this dog as i also have had to pay for all the shots etc. Is it possible i can take this idiot to small claims to force her to sign the pedegree into my name. Any help or advice would be greatley appreciated.

Poor puppy!!!!!! I would take her to small claims court.

Forget about her, she broke the deal:

She didn't retreaved the dog when it was available and she didn't pay the money. So she has no longer any rights over the dog, to the eyes of the court it's called "abandoned property" so you don't need her to sign anything, it's a dog not a car. And from the start you made very clear it was not a gift but a loan, you paid for the dog but she naver paid back so the dog is yours.

You can go to small claim court but I see no reason for that, keep the dog. Avoid any comunication with that psycho; the less you deal with her the better or she might do something psycho; just ignore her. And keep a record of all her psycho stuff and false reports.

I think you should tell her that if she doesn't sighn them over that you are going to take her to small claims court. And also if you got a restraining order then she can't text you or anything so you can use that against her if you do take her to court then bring up her issues and any evidance against that and any witnesses that may have noted that the puppie was there and that she never showed up to get him. Tell them that you have taken care of the puppie and even though she was apointed the puppie she lact responsability to get the puppie which means that they would be putting the puppie in irresponsible hands and that you care enough about the puppie to make sure he didn't die because her lazy *** didn't do any thing about it. You can take anyone to court for almost anything. Why is it so hard for you to get the pedigree papers, you have proof that you brought the dog, go back to the people you purchased the dog from and get the pedigree papers.

In short, the battle is too much - over a dog and control over some papers. I would not fight her and if she kept harrassing me, I would file a restraining order against her. In small claims court you should be able to see some justice.

Talk to a lawyer about your options. This issue sounds like it's effecting not just you and the dog and looks like it's growing. You need to get ownership of the dog in court (should be easy since you paid for the dog and have been caring for it), get a proper restraining order, and then break off all contact with her or this will never end nicely.

I don't know , but according to What I understood you went into her apartment and took the dog. I think this is illegal. If she didn't do nothing about it then I recommend you file a police report on harassment because calling the police 12 times is harassment.

I wouldn't go to small claims court with this. Fact is that you're wrong.

When you shelled out the $600, you made a gift of a dog to her. It was her dog then, and that's never changed.

The fact that you had to spend money caring for the dog is attributable to your refusal to give her the dog when the two of you split.

Give her the dog. If you think she's not going to care for it properly, call the authorities.

It's her dog, and she doesn't owe you anything for it. That's what any judge that's actually been to Law School is going to tell you if you sue her.

Give her the dog and buy one for yourself. Life is too short to get bent out of shape over a dog.
