Does anyone know what could happen if someone while on probation leaves state and is not found for 5 years. Probation is for underage consumption. And he was sentenced to 180 days in jail he sat out 82 (5 years ago)then was released and now he has been in jail for 96 days on a different case. Is there any chance that they will give him time served?

actually for one- this is my husband so I can't not just worry about it since we have a 3 year old together. This was when he was young. He was picked up here in Texas for something else he didn't even know he was reindicted on in Ohio. He spent 2 months here in jail then was taken to Ohio and has been there a month. Since the case was so old they gave him time served and let him go on the felony. But he had fines in another county that he never paid and a warrant was issued for it. This is also an old case and my husband HAS grown up since then. He is not a kid anymore and has a family that is depending on his return happening as soon as possible. I just wonder what could happen since 1 it is so old and 2 he does have a family now and has no other offences since leaving Ohio 6 years ago.

His probation was in addition to the time he has already served. The 96 days for a different case were as you said, for a different case and so that time is not likely to count either. Since he left the state in violation of his probation AND was arrested and convicted of another crime while on probation (which is another probation violation) he will likely return to jail for the violations.

This guy is making some very bad decisions. I hope he figures out how to be a responsible adult.

What is the matter with that person? One just can't "walk out" on probation unless they undertake a totally new life and make the required changes that it would require. Then, the government will still find you if they wanted. The criminal mind is not "wired" the same for criminals as it is for non-criminals. The offenders always have this thought that they'd "take a chance" but the truth is their desire to take a chance will get them caught. Yes, they can keep him in jail for the rest of his first sentence that he didn't complete. Then they will start working on the second case before he finishes his first sentence. As for getting time served, since he blew his first offense and punishment off, the chances are they won't take a chance on him not fleeing the jurisdiction again.

its really up to the judge and underrage comsumption is no big thing. If he was a minor then they probably wont even know about the prior conviction. but how can you ask us if they will give him time served on a seperate conviction if we dont know what the conviction is for. If he commited a felony he will most likely do more time but they will subtract his current time. If its a misdomeanor then he probably wont do anymore time. Your question is a bit confusing to be honest with you.

I think you should probably try not to hang around this person or worry so much about what is going to happen to them (unless it's your child) This person is bad news and you don't want to get in the middle of it.
