The statue of limitations to be prosecuted for most crimes is the maximum length of possible incarceration. For example, in your state if you look up the penal code and the maximum exposure for the crime is one year in the county jail - then generally speaking this is the limitation period.
If the crime is a felony and the maximum sentence is 3 years in prison - then generally speaking this is the limitation period.
