scream and cuss at the top of your lungs in a very civil public setting where children are present?

I don't believe that should be illegal. I understand that's it's disrepsectful and you may not want your kids exposed to it...but as it's your right to have your kids out somewhere....someone can do that as well. And do you really think that's what police should be concerned with.....a little cussing?

Freedom of speech is important. The example you gave is abusing the right and I don't know much about law but I would be willing to bet that there is some restriction on that. Maybe not necessarily a legal restriction, but I'm sure that someone would report the outburst and the person would be removed from the place. But I don't really know. And why does it matter if children are present? I don't mean to sound mean, cruel, nor careless, but I'm sure that the children will or already have heard such language it their life. If the perpetrator was cussing AT the children, that could be filed as verbal abuse, I think.

that is stupid, because then technically, where do you draw the line? People take different things as inappropriate, and there is no way to measure, and there is no way to draw the line. What is classified as "screaming"? What is considered a "cuss"? To some people, the word bologna could be considered a swear word, so there is no set standard, and there fore couldn't really be enforced. In theory, yes, screaming and cussing is innaproperate, but in practice, it couldn't really be measured, and probably wouldn't win in a court case. To many grey areas with what is considered cussing and screaming. and the kids have to learn anyways, otherwise they grow up after being sheltered, hear the f-bomb, and go into panic. it's how people actually talk, so they should get used to it.

Back in the day when America was a civilized society people didn't cuss in public or especially around children.
But unfortunately those day's are long gone as we now have people who don't think anything about cussing or talking about sex in public even with a child present.
Standing in line at the movie theater with my son I have to listen to people cuss and act stupid and while in the women's restroom with my 5 year old son I have to listen to teenage girls describe whose boy friend is better in bed and why.
And they use very explicit language even after seeing my young son whose looking at them wondering what they're talking about.
In the restaurant we have to endure people talking about sex or just using foul language and acting immoral and there's nothing we can do about it because they are seen as having more of a right to talk like that than I have of being upset about it.
America is decaying and falling apart at the seams and it's very depressing for society to be like this especially when you can look back and remember a time when it wasn't like this.
Remember a time when people had respect for one another and were outwardly decent human beings.
In my opinion talking like that is not exercising freedom of speech it is just being corrupted and perverse and in a way can even be considered child abuse when they deliberately do it in the presence of a child.
I live in the Bay Area,California and it is so unbearably corrupted here and so widely acceptable to behave in such a way that we can barely tolerate it and want to leave more than anything.
But due to finances we are unable to move and are stuck living in a place that in my opinion would be better off dissappearing into the ocean.

As old as Larry King is he might have interviewed James Madison.

If he did Pres. Madison would have pointed out that the 1st amendment was to make sure that political discussions could take place in a civil manner.

All the responses referring to Disturbing the Peace etc are correct. It varies from state to state and town to town but most if not all have "blue laws" to some extent. many will shout that YOU cannot shut them up because of the 1st amendment, they are wrong. You are not Congress and are not passing law.

Sounds like you have taken a trip to the fair city across the bay from me and witnessed our eclectic street folk.

freedom of speech is your right and my right and the right of any American citizen. if you don't like what you hear, you have the choice to leave, turn the tv/radio off, by using another freedom - the freedom of choice. to show opposition to those who scream and curse at the top of their lungs only requires you to remove yourself and the children from the situation and have the opportunity to explain to them how lucky they are to live in the USA because you have the choice to not listen or agree with those types of people. it would require you to be pro-active. good luck to you

Well, I disagree. Words are words, no word is worse than any other.

But, there are laws against violent verbal outbursts. There are also ordinances for noise pollution. Police have the right to ask people to be quiet in public places.

So it's already covered.

I say, just relax. Life is too short to worry about such nonsense.

ironic, the ones that are doing that are the parents of the kids..lack of control in my view

to answer your question, they call it common sense, but hey we all have a bad day.
no it should not be illegal
what should be illegal is cell phone use in the theatre, or movies
or any public place that people feel the need to let others know they have a call.

You have the freedom to tell that person to stop being rude and obnoxious.

no it shouldnt b illegal..dont try act like u dont cuss and **** dont b a dumbass..what if its illegal 2 do something u really like..u would b cussing all over the place..dont give me that **** that "o no i wouldnt cuss" thats a lie..and the children they dont learn badwords 4rm ppl they learn 4rm tv and even 4rm u..wat now ur probaly thinking he is right..as 4 the other ppl who put it should be illegal
