I been separted to my husband now for about 2 month's and I am taking him to court on July 24th for child support and support for myself. We have 4 children and I am also pregnant with our 5th child. He keeps telling me that I am going to get a little bit of money. He is also paying child support for another child that he had with his ex-girlfriend. He pays $550.00 a month for that one son, so I was just curious to know if my children will get the same amount or less? Also, are they going to decrease the amount of money that his first son is getting in order for all my children to get an equal amount. I been a house wife for the pass 5 years and my husband is also in the military. Do you think that I will benefit from that?

Thank you all for responding....

You said your husband is military, so your first stop is there. You husband is paid a housing allowance every month. If the children are with you that money should be allotted to you by automatic deduction. Secondly, the court will NOT decrease support for his first child. They will take that amount into consideration when calculating your support order. Your husband will get credit for paying for the first child. Your children's support will be calculated based on whatever income he has after that and what income if any you bring to the table. He will also get credit for providing the medical insurance (I'm assuming that since you're a military family you receive health benefits).

Is this marriage reconcilable? If so, I would advice getting counseling before you put this additional strain on your family. Being a military family is hard, being a single mother of 5 is harder.

I'm a former military wife, I may have some insight to help if you need it.

Your children will get child support in the amount allow by child support enforcement. It doesn't matter how many children he is already paying for. I'm not sure how much you will benefit from all this, but for 5 children it is costly to raise even one. I wish a lot of luck.

I am not sure what state that you live in but it depends on here in pa they will take in to consideration that he has another child. I am not sure what state you are in but here there is a website that you can go on to figure out the calculation that he will have to pay. Talk to a lawyer and see what they tell you?

Oh yeah - you're gonna be totally LOADED! But seriously - I'd be worrying more about your kids emotional needs at this point. He'll have to pay no matter what. Even if they have to garnish his wages.
